70 hr question

    I have a question about the 60hr 7 day - 70hr 8 day rule. Im new so please forgive me if its a stupid question to you seasoned vets.


    My company has a 4 day on 2 off schedule. 14 hr days are practically guaranteed. The fmc book says 60 hrs in 7 days and 70 in 8. I probably just answered my own question but I wanted to get reassurance from some of you veterans on weather I am operating illegally if I run 70 hours in 7 days on a 4 on 2 off schedule?

    If your company only operates ( dispatches trucks ) on a 6 day schedule then you are under the 60 in 7 rule, if they operate ( dispatch trucks ) on a 7 day schedule you are under the 70 in 8 rule. IN other words if they are closed on Sunday and dispatch trucks after 12:01 on Sunday night they are a 60 in 7 , if they operate Sunday thru Sat...they are under the 70 in 8.

    Assuming you are on the 70 in 8 schedule (ask company)

    If you do 70 in only 7 days, you will not have any hours left on day 8 and will need to take a day off.

    If you do 4 on 2 off though you will run out of hours on day 8. I highly dought you will have 14 hours on duty though everyday. If you have any down time at all during the 14 you will log off duty or sleeper.

    They are open on sunday and dispatch trucks 24 hrs a day 7 days a week, so looks like I am on the 70/8. So it would be illegal to run 70 hrs in 7 days right?

    Thanks for the response! I was thinking the same thing about day 8 that's why I decided to ask you veterans. They have a couple guys running illegally here but I don't want to fall into that category so I want to find out the answer here before I ask (or tell) the company. It's's one of those jobs were you pretty much have to let them know when you're out of hours because management doesn't really pay that much attention 2 who's out of hours.

    I cant log sleeper because their day cabs, and the only down time we have is when we're at the shop waiting for the truck to get loaded or at the site waiting for the company man to approve the work we are about to do or have done so I can't log of duty during those times the only time I log off is what I'm doing my 10 hour reset

    why would you want to? you will get to the burned-out point quickly doing that.
