A Couple of Questions

    In a sense your instructor is correct, you can not be in the drivers seat or the passenger seat while off duty. If you are in the sleeper, you are not off duty, you are in the sleeper. That doesn't leave very many places in the truck to spend 2 hours off duty. It's a technicality that was not explained well. The proposed new HOS will address that tidbit of stupidity allowing you to be off duty in the cab. Good luck with your school.

    However what I found, after posting the original question, in a packet on the FMCSA website is that the 8 hrs needs to be in the sleeper and the 2 hours can be sleeper birth or off duty... So it is not as set like she originally said in class, where she said that the 8 has to be in the sleeper and the 2 HAS to be out of the truck off duty. I am still reading and re-reading portions of the FMCSA and other Commercial Information to knuckle down on things, I will get it. And I appreciate all the responses and input, even the stuff that turns out to be wrong helps point the way in the right direction..

    SmartDriver, Now your going in the correct direction. At least half of what you hear on the CB, or at the truck stop, or read on forums will be incorrect to some degree. Collect the info and then verify using original sources. If you go to the FMCSA web sight you will find that they have a FAQ page with normal language explanations for all of the regulations.
