    Indeed. Some states are tougher than others. In Massachusetts if you refuse a breathalyzer, state police have the authorization to suspend your license IMMEDIATELY,CDL or not,pending further investigation.

    You didn't have the common sense to not drive while drunk? And you want someone to entrust you behind the wheel of a 80, 000 lbs potential weapon?

    The OP did admit his mistake plus he stated that he pulled to the side of road and fell asleep after realizing he was too impaired (most people with DUIs don't even do that nowadays,they try to keep driving). Unfortunately Jersey is one of those states that will prosecute if you're sitting asleep behind the wheel even if the vehicle is parked.

    That guy pissed me off so much that I killed him. I realized as the life was being snuffed out of him my rash decision and mistake. Regrettably it was too late. I admit I was in the wrong

    Not implying the OP is a bad individual, just saying there are some things in life that you have to meet certain stringent criteria in order to do and 1 screw up bless that chance. Not everyone can serve our great country via the military, much less an elite force. Not everyone can enter Canada due to just one screw up. Same should hold true for CDL holders. Armed robbery or assault is more acceptable than a DUI when it comes to being a professional driver.

    If the OP wants to perform or contribute to the transportation industry, perhaps a support role is more realistic, such as planning, dispatching or CSR.

    Of course this is just my opinion, but I feel very strongly about rewarding past behaviors that directly correlate to future endeavors. Would you want a pedophile that has been good for the past 30 years babysitting your children?

    Who gives a shot if the OP "admits his mistake"? The fact is there are consequences that come with mistakes. Little mistakes, little consequences. Big mistakes, big consequences. I get so tired of people trying to get out of paying for their mistakes.

    Just because you're a CDL holder some things you're not exempt from even if it happened in your personal vehicle.A refusal is as big of a thing as a reckless.You look at the requirements on carriers websites and some will say no refusals ever meaning drugs or alcohol.

    Texas is the same way, refusal is an immediate 6 month suspension and you still go to jail. But if they don't test you, and you look sober on camera, there is a decent chance you can beat the charge in court.
    Depending on the county and time of year(Holidays esp) we have designated "no refusal" dates though. If an officer believes you are impaired, and you refuse to take a breathalyzer, a judge is always on standby to fax over an order authorizing a blood test. They can forcibly arrest you, drag you to a hospital, restrain you while someone stabs you with a needle, etc.
    I support safer roads, but I disagree with the scenario above. No one should have the power to insert a needle into my vein against my consent.
