    Nope. Refusal is finis. Literally not hireable.

    What you CAN do is find a bunch of money, buy trucks and trailers and become a company. This is a free country. If no one will hire you to work for them, become a self employed working for yourself.

    Put down that bottle if you have not already.

    Is this the only thing on your record? seems unusual that they won't hire you although maybe its more to do with the fact your a new driver, look for companies that are willing to hire drivers with no experience.

    He got the DUI in 2011. Nowadays most companies won't touch you unless that DUI occurred 10 years ago or longer.

    The key word here is time. Today's trucking companies are needing warm bodies in those trucks they are willing to drop standards a bit now. I believe in 2nd chances once you have established some time and show you have learned. However refusing to test while holding a CDL regardless of if you are driving a CMV or not is a one year suspension of that CDL as per table 1 in 383.51. If hazmat is involved it is 3 years the first time and lifetime if you do it again. FYI take special note to the far right column! Be aware. If I am understanding this correctly the OP was not holding a CDL at the time. I understand the OP finally got a job. Just as a side I have been privy to some talk that the FMCSA is planning to tighten up 383.51 a bit. I do know they are attempting to get their MRO positive drug testing database up and running. Does anybody in here have any idea how many CMV operators/people holding CDLs get stopped for DWI/DUI everyday in the US? Does anybody have any idea how many alcohol tests come back positive? I don't have the exact figures but the numbers are high and the FMCSA is noting this and developing rule making to make it harder to drive a CMV with any kind of recent alcohol history.
