A question about 16 Hours

    I work for a foodservice company. Some of our routes are routed where you are out longer than 14 hours and told we have to use the 16 hour rule. Can anyone tell me if that rule is designed to deliver or In my understanding the rule is for weather, traffic etc any help on this would be helpful thanks

    You can only have one day in a week that is 16 hours. There are more answers at this link.

    -1. What is a "duty tour" as the term is used in Part § 395.1(o)?
    The 16-hour exemption in § 395.1(o) is designed for one-day "duty tours." The duty tour is the interval between the time a driver comes on-duty and is released from duty on a daily basis. This period begins and ends at the driver's normal work reporting location and may only be used following 10 or more consecutive hours off-duty, 10 or more consecutive hours in the sleeper berth, or a combination of 10 or more consecutive hours off-duty and sleeper berth time

    Thats what im saying its for special circumstances right not to add more stops and more freight?

    No they will add stops and backhauls and inform before we roll to use the 16 hour rule and we arnt in a sleeper its daycabs if that makes a difference

    I've run the 16 hour rule once during a flood situation where the roads were closed and it took extra time to get home, note, I made this run in 12 hours all the time... so this was definately an unexpected one time deal.

    though a few years ago, I had a boss that wanted me to use it regularly to extend my driving time... nope... not even close to legal... so I didn't do it.

    guess who pays that ticket if you get caught?

    not the boss that told you it would be ok. lol

    jcumberland, what are your runs all 48 or are you local means atleast 100 miles within your terminal? If you are OTR driver then you will be in violation of the 11 hour and 14 hour rule, if your local and stay within the terminal area usually you are not working 7 day straight. If your only working say 5 days a week then most companies are exempt from this rule if I remember correctly because most of these driver work off the 60 and 70 hour work sheet meaning in the last 7 days you can work 60 hours or 8 days you can work 70. Just went over this last week while getting my CDL'S back. Hope this helps really need to know what you run.

    Its not over the road its local. Ive had several people tell me it was illegal. Couple of guys who came here that where trainers at other companies, but they were otr guys.They just said that the rule was for weather,mechanical,traffic that sort of thing not to be used to do extra work.Like im6under wrote, its us that pays the ticket[

    I used to make a relay run from Springfield, IL to Chicago daily.

    Since I left and returned daily from the same terminal, I was under the local type rules. There would be one day, about once a week or every other week, that the day would end up being 16 hours long. It was not the result of weather, or traffic. It sometimes was just the way the day went. I logged it as I did it, it was legal. Took the 10 hour off after. It is something that can be planned for one day of the week, but not everyday.

    But its my understanding if you mix your "local" run in with your OTR runs in a 7 day period you would have to log it all as OTR
    So your 11-14 would still apply
