Does anyone know what ropes i need to jump through...I had a owner operator lease his truck on back in December 2012 and about 3 weeks ago he refused to pull any loads until he could get his tag on his truck because it was going to expire at the end of February so I paid his check on Tuesday instead of Friday so he could get back to work. later on that night he sent me a message and said he was busy and would get back to us so in the mean time I shut off his fuel card. well I called him about 3 days later I got no answer, after about a week and a half of me continuing to call I finally get angry and told him if he didn't want to work here fine but I wanted my trailer back as well as my fuel card. still no answer after 3 more days I send him a message if I don't have my equipment back within 24 hours that I was going to notify the authorities of the situation and the next morning I get a message that he left the trailer at his friends house and that's where I could get it...when I went there to get it I realized that he stole my tarps, stole a brake chamber off of the trailer, stole the chains and ratchet binders off of the headache rack.. and destroyed a brand new set of tires on my trailer. I had put them on the week he started pulling the trailer and the way it appears is he hooked to it. set the trailer brakes and drug it about a mile or so till the metal was coming thru the tires. I filled out a police report but I am having difficulty not going to his house and showing him how much money he cost me. can anyone give me some good sound advise because this right here kills me as i just bought my 3rd truck 3 days ago and when I got there today to get this trailer back I just lost it..any advise please message me..thanks Sincerely Patrick

File an insurance claim, take him to court for the rest, and place a lein on his truck if possible. Also note his DAC accordingly.

Your police report goes a long way, but you need to keep on them to find out what they are doing to recover your property. Is there anyway to identify the stolen items as being yours?
File the claim with your insurance. If you have to, hire a PI to find out if this guy owns a house, car, and the truck. Place a lien on it all. You can do that yourself at the county courthouse. Take him to small claims court or sue him for the damage he did and the lost income from those damages. Talk to an attorney to see what else you can do.
Basically I'm just telling you the same thing J_Frog did. Just do not go over to his house and do anything stupid. It would be your luck that when the cops got there you would end up in jail and he would own your business.Leftlane101 Thanks this. -
What did the police say ? I don't think you can put a lien on anything . I know you can't put a lien on his house for this . In reality you have not proved any thing was done by him i am guessing ? Again what did police say ? I think you chalk it up as a cost of doing business unless the police are able to charge him short of that sorry i think you are out of luck

Driver of year i a going to speculate. Seen this in past 1 He is a ahole ! 2 mad was not making $$$ this is slow time for flatbed 3 had to pay trailer rental on a slow or bad pay week . There is no good reason to do this if FTL patrick owed him $$ he could of tried to hold trailer hostage and would have got his $$ But who knows there are two sides to the story and the truth sometimes lies in the middle somewhere
