About Getting Paid...

    Hi,
    I'm going through some tough times right now because the trucking co.
    i was hauling loads for under my own authority,they brokered the loads,
    we had a little falling out and i moved on and am trying to cut all ties with
    them completely and they owe me $2,200 still,i emailed the night before and asked if any of my money came in yet and got a reply NO,so i called,
    like always nobody answers the phone,so i left a nice message saying that
    i might have to resort to legal action because it had been past the 10 to 14 day waiting period they told me and later that night i got a very rude
    call saying that "THEY HAVE THE RIGHT TO HOLD MY MONEY FOR 30 DAYS
    AND IF I SAY THAT AGAIN THEY'LL HOLD IT LONGER" and i received some money but not all,funny how it went from $0 to we have some now.i also
    have an ins. claim that happened while working for them and my ins. is on it and nobody else is in a hurry to resolve it and i "OWNED UP TO IT" like he said,anything i can do to resolve this and get my money without court, some are past 30 day's 6 are past 45 day's,what can i do

    unfortunatly it's very common. I don't think we ever had a company payy all our money after pulling our trucks. That's why now I know to take a nice "vacation" and let the settlements come in... then pull the trucks.

    we have a produce broker in CA we ran exclusivly for and we pulled 6 or 8 trucks and he stiffed us for $22k and that was 1991.

    Best thing to do is to get to work, keep producing income, if and when that money comes in be thankful you got it. Don't just sit around and wait to be paid, get working.

    Thank's,and i'm not sittin' waiting for that money i'm to old to do that,
    i already talked to some people and have work lined up,i was waiting for
    my ins. to add a 2 mil. umbrella and unowned trailer on my policy,2 wks.
    for that,and i got very ill over this past weekend,visit hospital type ill
    and should be workin' in couple day's. Thank's for the advice

    file on their bond they will pay when they get the call from whoever holds their bond

    THAT'S THE PITS , BEING LEASED ON WITH A COMPANY AND HAVING YOUR OWN AUTHORITY! And then USING A BROKER ??

    They're using you and at the same time pocketing the profits.

    If they Know you're trying to Cut Ties with them, then Yes, they have the right to hold all Monies for at least 30-60 days, in case of any claims coming in on them.

    Hopefully you have all paperwork to back yourself up and especiallly copies of the bill of lading.

    A Good Fast Easy way for you to collect on your money, is to call the Shipper and complain to them , this company is not paying you the money due.
    A trucking company does not like for that to happen , for the fear of losing that customer. But it was a broker load.
    Find out if the broker paid out to the trucking company.
    And if these loads were under your authority and insurance, then by all means, start submitting bills with late charges to the company.
    Make sure you also send a certified letter to the company stating, that legal action will be taken if you're not paid within the 30 day time frame.

    ha, ha, ha, that's f u n n y !

    yes, by all means, be assertive. , meaning, keep calling them and bugging them until they get fed up., like a bill collector. Sometimes that works, when they decide to pay out to get you to shut up.
    been there and done it.
