Got a question for you all.....I know someone who has a Florida CDL and was pulled over in Cali for speeding, got a lawyer and the charge was dropped to "stop and go" which is 0 points in Cali. According to the Florida Law:
You must notify the Department of Highway Safety and Motor Vehicles within 30 days if you are convicted in any other jurisdiction of any traffic violation (except parking). This is true no matter what type of vehicle you were driving.
Would a ticket with 0 points need to be reported? He does have to pay a fine of $380.00. Anybody know? Hope it's not a stupid question, but don't want to report information unneccesarily.![]()

I don't think the points matter. I think if you're convicted (or accept a plea) as long as it isn't a parking violation, it must be reported to your state and your employer withing 30 days.
-
I may be reading you wrong here. Frankly I hope I am.
But it looks like you are talking about reporting somebody other than yourself. I have to ask myself, "now why would you want to do that?" -
You're right Big D.
I wonder though, if CflTeam meant >>but he doesn't want to report information unnecessarily.<< ? :smt102

No, I'm not reporting anyone, just trying to help someone figure out what they have to do to stay out of trouble. That's why I'm asking because if it's not reportable it would not be in his best interest to report it. However, if it is, he needs to get it done, to stay out of trouble. Sorry I didn't clarify that.
So, do you also report seat belt fines? Just wondering because the lawyer said that this stop and go was basically the same "penalty" as a seat belt violation, that it would not show up on his record. -
The conviction needs to be reported to the state. In addition there is a federal rule for truckers that require them to report the conviction (except parking convictions) to the motor carrier/employer within 30-days.
As far as points; it makes no difference. It's the conviction that counts. In addition, there may be points assigned by Florida as the individual states set point policy. As an example: 2 points in Michigan may be 3 points in Ohio, and 1 point in Indiana. On top of that I can assure you that Illinois has no point system at all.
From a retired federal DOT officer.CflTeam and AfterShock Thank this. -

Thanks, Psanderson. I was wondering about the point thing since all states have a different system. Good information!

Hope I'm not beating a dead horse here, but I was looking at the code violation on California DMV site and it says the following:
Stopping and Parking
23333. No vehicle shall stop, stand, or be parked in or upon any vehicular crossing except:
(a) When necessary to avoid injury or damage to persons or property.
(b) When necessary for the repair, maintenance or operation of a publicly owned toll bridge.
(c) In compliance with the direction of a member of the California Highway Patrol or an employee of the Department of Transportation who is a peace officer or with the direction of a sign or signal.
(d) In such places as may be designated by the Director of Transportation.
Amended Ch. 545, Stats. 1974. Effective January 1, 1975.
Florida law says the only violation that doesn't have to be reported is for parking......Is this a parking violation?
I supppose he could send it in to Florida and they can decide what to do with it, but I don't trust the state on these matters, maybe it's something that shouldn't be reported, but if you send it in to them, they'll find a way to put it on your record.
Again, I just dont want my friend to turn in info to Florida if he doesn't have to..... -
So how would one go about reporting a ticket to the state?
I have only had one ticket in my life, a fix it ticket for not having a license plate bulb when I was sixteen...So I really don't know.
