I had a semi accident back in January. I was sleeping in the bunk and the other driver was driving. Wind blew us off causing the truck to overturn. Causing dame to the truck and me as well(back injury) I work for an independent contractor so I carry my own insurance. As for me, well I am under treatment (physical therapy, chiropractor, and regular visits to the doctor) my insurance (occupational non occupational accident) is covering my medical expenses and i receive some temporary disability check too. My question is, if I am to sue who would it be? And what kind of attorney would I hire?
Anybody who is been in this situation please help.

This is beyond stupid. Waaaaay beyond stupid. Dam_ sue happy idiots. I'll tell who to sue. Sue yourself. You were in a truck with the wind blowing. Were you buckled in the bunk the way you were supposed to be? NO you say. Then accept blame for your negligent behavior and sue yourself. I am sure there is a scumbag somewhere who can help you with suing yourself. Honest answer. For real. Do you believe in God? Sue him. He made the wind blow. He put you in that dangerous situation. Close this thread PLEASE. The problem has been solved.

Who you going to sue and for what? You're co driver knew it was windy out he should have parked it till the wind dies down.So if you wanna sue then sue the co driver.ZVar and lovesthedrive Thank this.

If you were operating a big truck (Not necessarily driving as you told the story, your teammate was) in a high profile vehicle warned zone for high winds, hurricane force winds, a Bridge warned and closed to big trucks for wind, and into or near a twisting storm (A tornado) etc etc etc. That can be proven to exist outside in a court of law a enemy Lawyer can wash their side's hands by stating that in your Professional Opinion it was ok to take the big high profile vehicle outside in the high wind warning, storm warnings etc that are active. Therefore they are not going to accept any damaged claims or processes. You have to bear the losses yourself.
Do you see where I am coming from? The Courthouse is not a nice place, there are people who are so bad they can indict a ham sandwich and have it condemmed to death.
Now that I got that out of the way... I will say this. Im so sorry that you have had the horrible experience with this wreck. I do not want anyone to ever have to endure such a wreck. Meaning those of you morons running out against a advancing thrunderstorm front generating 90 mph winds while crossing the New River Gorge bridge probably do not know better and do not deserve to keep on trucking. And the Industry does not get off scot free either. They have a constant peer pressure at very unbelieveable high pitch of stress forcing people to keep those wheels rolling by creating a get going NOW situation regardless of the weather out side that will probably do it's best to destroy the truck, you and the load.
There needs to be changes in this industry so that YOU the driver in the end of day know there is a THREAT presented TO you, your truck and your load plus anyone sheltering from the awful wind on the otherside of you.... you then will simply stop driving for a few hours or a evening without fear of firing, service failures, retribution from nasty dispatchers etc.
YOU sir, is the captian. And your co driver is a team. Be good to each other. Safe haven for a while in bad weather is always a benefit.gentleroger Thanks this. -
