It really depends on the insurance company. The ones I have dealt with gave no down time paid if you get a rental truck, it's one or the other. Your down time has to show on paper your average wages. Payroll stubs, average hours, be prepared to hand in lots of paper work. Most of the time lawyer's are not needed and most lawyers are not interested in property damage, only personal injury. Not sure of the damages, but lost time has to be proven. Expect a check for both between $3000-$7000.

I am going through this right now. My truck is still in the shop,.. its been 30 days.
Mega said they would take care of everything. All I had to do was sign a release and I would be paid to repair my truck. After reading over the release form,.. it stated that I was releasing them of any and all liability,.. present and future. No mention of lost revenue at all. I questioned this,.. they offered $750 toward lost revenue,.. $150 a day x 5 days,.. they claimed that was standard in the industry. I blew a gasket.
I refused to sign,.. I ended all communication with the mega. Filed with my insurance and hired an attorney for lost revenue.
I was hit April 21st while under a load. I band-aided my truck and made my delivery. Dead headed from Jersey to my home state of Fla, something told me it might get drawn out and I did not want to be stuck in a hotel 1000 mi from home with daily expenses. Much rather fight it out while at home.
My truck should be back on the road next week.
Good luck with what ever you do. Personally, mega's are not to be trusted.

I contacted the laywer for down time, she is ready to help me for 30% of whatever she will pull out of SMITH and 40% if they have to go to a court. She advised to rent a truck if im able for it not to look like im trying to sit and do nothing and get payed for it.
Everything suppose to be reasonable, For juries in case it will go that far. Based on her almost 30 years experience 10% of time they pay right away whatever you requesting, 10% they refuse and the rest of the time it takes of 1 to 6 months of negotiating and making a deal.
that lawyer also referred me to a personal injury one that again gave me a free consultation. And said that if my injuries are minimal it wont make financial sence to even start. But advised me to go to a doctor to get checked and was going to pull a lolice report, and only then decide whether i want to do it or not. They both a well known all over the internet so i kinda trust them but still havent decide whether i wanna go that route.

I think you have to get a lawyer anymore Until you do, the mega will just screw you around. Ain't nothing going to happen until you get a lawyer involved these days. -
I still can call a lawyer or get insurance involved any time.
You are probably right when you say that they not gon pay unless they hear from lawyer....
But i really like the fact that everything regarding making decisions is in my hands... who knows maybe they will turn out to be reasonable.
So far it rearly failed on me and i want to stay faithful to that principle -
Not sure I understand,.. are you on a lease purchase,.. or do you own your truck and leased to a carrier?
I am leased to a carrier, but my truck is mine,.. paid for. My carrier provides liability and cargo. I provide basic bobtail,.. plus I have an additional collision/collateral coverage added to my bobtail policy. Even though my truck is covered on my carriers insurance while under a load,.. which it was,.. I have the option to go through mine or my carrier. I went through my personal insurance,.. though even if I had gone through my carrier, which I have had to do last summer,.. even in that situation,.. its between you and the insurance provider. The carrier has little to no involvement. Unless of course,.. its their truck,.. in which case I would have let them handle it.
Mean while your truck is down, your not making any money, your expenses are multiplying. Expect the mega to bend you over at any opportunity possible. I'm not questioning your intelligence, but unless you understand which forms to file and legal jargon and motions to file against the mega,.. its really best left to the professionals who do that for a living

Im leasing a truck and im under their authority, so all that has to do with insurance it under their name.
And the way they handle any situation is just to be done with it even if means a loss. They not going extra miile for themselfs and i cant expect them to do it for me.
