Accident. Dealing with a mega carrier on the other side

    No offense,.. but not sure I would want to stay with a company like that. I understand if your committed to following through,.. but I dont like not having say over my truck.

    Well...while i agree about them not being perfect, but neither am i. I can see why they wouldnt want a claim on their insurance. On the other side they offered me a truck for free, and i refused to take it unless they gon rent it to me...
    Im dealing with adjusters manager directly and in case he will want to fight it.....
    Like one police officer told me while writing me an oos after i gave them attitude - you f....k with the man that have a pen - he will f....k you with pen...
    and i realized how powerful of a statement that was...
    i have at least 11 hrs every day and so much crap to pass on to someone to make their lifes seem miserable.

    #3 they will F U on it.... the great pumpkin thinks a O/O should only get $135.00 a day for down time

    the great pumpkin did a hit & run to my truck (thank god for dash cams) took almost a week for them to say they would cover it, i had already fixed part of it so i could run until home time... as soon as they said they would cover it they cut me a check for the door mirror, when i got home i took it to the dealer for the rest of the repairs, they cut a check right a way to cover the dealers work.... then the down time came up.... they said they only pay $135 a day and the repairs should only take 3 days.... well the total number of days i lost were 11..... so i call a lawyer with all my numbers.... gross pay for the year and total numbers of days i was out..... avg. per day for that year was $934.... 11 X 934 = $10,274.... that's $9,869 more than the great pumpkin wanted to pay.... after the lawyer i got $8,250

    I don't know if you own your own truck, but any documents that can show a loss of work, not down time can also be included in loss wages. Emails asking for shipments to be moved is an example.

    It will come down to whether your or the carrier's policy has physical damage on your truck. I've been through this myself. Out of pocket about $3,000 to get the truck back on the road right now. Then my insurance sent a check within a week and covered part of that plus some additional repairs, less the deductible. Then it took another 6 months of staying on my insurance company to subrogate the claim to the other party's insurance. That got me a check for the deductible and zeroed out my loss run.

    In any event, business continuation is on you immediately, then you have to make your case in court more than likely to collect. Keep in mind when you're figuring out what to claim, that you're going after lost "profit" not "revenue." Obviously the other guy isn't going to pay for variable costs while you're in the shop, since you have none. It sucks. The only one in the world concerned about your well being and business health is staring at you in the mirror.

    Look you screwed up.

    The problem I see is you may have caused a termination in your contract with the company you leased the truck with, it isn't your property and it isn't your decision to have them involved or not involved. The insurance is there for a reason to mitigate the costs to the company and have the property repaired without a lot of downtime. YOU side stepping the company on something you don't own allows them to no legal latitude if they take back the truck and this is why the possibility of a termination is real.

    At this point, you need to call the company, let their legal people handle the issues and eat the costs involved on your part.

    Also why not name the company, this is a simple parking lot accident, right?

    I may have misunderstood but I thought he owns the truck and leased it to the carrier. However his carrier is paying the premiums so I would imagine they might like to know there was an accident.

    Look - before you open your mouth open your eyes, possibility is you may not look stupid next time...even though i doubt it

    Im at full responsibility for that truck and my company aware of every step that i make regarding it. Im doing them a favor by keeping it off the record.

    When you get to the point where you will have to decide what to eat and what not - you can go ahead and eat as much as you can digest. But when it comes to my hard earned money i will fight every penny. Whether people like you like it or not.
    Another thing is - you dont have to be genius to recognize who i meant by SMITH...

    To all others - i really appreciate all the replies and support from fellow truckers.
    And I'm sorry for profane talk... just cant stand disrespect

    Respect is a two way street.

    You came on here posting about a problem and asking for advise, yet you already have your own agenda to solving it. Why even come here if you have no interest (Or respect) in what other people who have already dealt with this are giving you?

    Personally I dont care who you leased a truck from. You chose to put yourself in that situation and reading between the lines,. it appears you need them more than they need you. In my opinion,.. you are stuck in a fleece and trying to manage it as best you can. Again,.. this is your business,. not mine.

    What I see here is that through your own choices, you are where you are by your own business decisions,.. perhaps ignoring the advise and opinions of others as a result? So here you are on TTR,.. asking for advise,.. and yet again,.. you've already got your mind made up and following your own strategy. Good luck,.. hope it works out for you.
