Accident in Albuquerque, I Need Advice

    When I rented from Penske it was their authority and IFTA, my insurance. Took all of two hours to get a truck when I needed one badly., and I even took it into Canada...

    I'm not the OP. But I have as much experience as just about anyone here with ABQ traffic, and I'll supply an educated guess. I40W for a couple miles before our "Big I" (I40/I25 junction) and the Rio Grande and/or Coors exit is often a problem. The Big-I reconstruction essentially ignored the exits west of the interchange, and it's been screwing up traffic ever since.. It's almost a guarantee that I40W will come near a complete stop between 15:30 and 18:30 due to the commuter traffic exiting the city center to return home.

    I was in a wreck in September. It was very clearly the other drivers fault. They admitted it, got tickets, etc.

    I was dreading the repairs because my truck was less than a year old and had very low miles. In my case the insurance company was very easy to deal with. I had a check in a week and I traded my truck(in wrecked condition) and the insurance check in on a brand new 2016 and only had to pay 7k out of pocket. I didn't think that was bad to get a year model newer brand new truck.

    I just told the adjuster from the beginning that I was a fair person and not looking to get rich off the deal I just wanted to be made whole again and if they were fair with me we could settle it really quickly but if they tried to screw me around I was going to get a lawyer and get every penny I could out of them.

    Nothing too complicated bud. Traffic came to a dead stop due to an accident being cleared about 1/2 mile ahead of us. The truck behind us, never saw any red lights come on and slammed against our rig... We where on I-40EB at around MM 170.

    I want to thank each and everyone of you for posting very valuable information and also for your empathy and good wishes.

    UPDATE:

    NM crash report names the trucker that rear ended us at fault for the whole incident. Our truck was deemed a total loss and there is word of a check coming for the difference between the amount owed to the finance company and the value of our truck. BTW, it seems spot on.
    As of right now, I'm in daily communications with the insurance adjuster, just sending receipts, proof of income and lost income, quantifying property losses and so forth.

    At this point, everything looks good, insurance is doing what they are supposed to do. So far, we don't see a need to lawyer up. We might if, come settlement day, we feel there are deficiencies.

    It is a wild ride, can't wait to put all this situation behind. Thank you all for reading.
