Accident liability question

    Ok my husband is a new trucker and I'm wondering about if he were in an accident would he be liable to the other driver? Anyone know what the rules about that are?

    my best friends husband was in a bad accident over 2 years ago. The people in the other vehicle died. He had credible witnesses (like a cop, or the like) that he was 100% not at fault. His log book was accurate, he just started out for the day.

    Fast forward to this spring, the passengers family is suing his company and him too. I guess he was named because he was the driver. This is all still pending, and we (my friend, the lawyers, company and I) all agree that it is about money.

    Anyone can sue you, whether they have a leg to stand on or not.

    For the most part, I guess your employers insurance would just take care of the physical damage, this is a special case.

    Of course he's liable if he's found to be at fault. He's driving,right? You're asking if he can hide behind the companies insurance carrier and walk away, right? This here is the USA, we sue anyone and everyone, right?:biggrin_2555:

    The rules pertaining to accidents can be found in your federal motor carrier handbook (390.5)390-15)if you don't have one, most truckstops carry them for $4.95...Read it (memorize it) It's our bible...
