Wow talk about an open ended question.
Well a number of things will happen:
- Alcohol and Drug Testing usually within 24 hours of the accident.
- Temporary suspension by the company while the investigation takes place.
- DOT investigation including; log books, qualcomm records (if applicable) BOL record checks (for Pickup and delivery times)
- Endless discussion with company and personal lawyers.
Just to name a few things off the top of my head. -
What F550 said. I (believe), it must be within 12 hrs. but it may be less.
After the drug and alcohol test, the driver will receive the most anal retentive inspection of their logs and trip tickets they can possibly imagine. This is because "Professional" drivers are seen as ATM's and are considered at fault from the beginning. -
Alcohol Testing usually within 8 hours of the accident
Drug Testing usually within 32 hours of the accident
Each employer is required to test each surviving driver for alcohol and controlled substances as soon as practicable following an accident as required by §382.303. However, if an alcohol test is not administered within 8 hours following the accident, or if a controlled substance test is not administered within 32 hours following the accident, the employer must cease attempts to administer that test. In both cases the employer must prepare and maintain a record stating the reason(s) the test(s) were not promptly administered.
Like everyone else said you will be inspected totally, equipment , logs, driver, BOLs, shippers for pickup times, fuel reciepts, prepass records, weigh stations times, qc records from company & thats just if its not his fault.
If they believe it was his fault it will be alot more involved. -
I wasn't involved in a fatal, but a very serious wreck in '01. Drug/Alcohol screen done 14 hrs after the accident (took the company that long to find the place in Arlington, Tx where I was supposed to go). The city cops didn't mess with my logs, BOL, etc.. But I did have to stop three times on the way back to Denver ( I was on my way back as it was from Houston to Denver) and talk to the insurance company. When I got back to Denver, the company took my logs, pre-trip book, and BOL's and locked them in the safe (I got back on Sat. morning) and told me to come in 8am Monday. They put me in one room while the insurance man nit-picked my paper work and me for 5 hrs. The insurance company and the Arlington cops later cleared me of fault in the accident.
We were still sued and the lawyer for the other person subpeonaed my logs, pre-trip, prepass reports, port clearances, fuel receipts, meal/ATM receipts, time slips from the Port of Houston-Barbours Cut, Drug/Alcohol results, I think even my medical records, blood type and shoe size. The court later dismissed the case against me and the company. -
know a guy that had one here in pa a few months ago (car turned left in front of him ....teenage girl on the passenger side killed) cops took him directly from the scene for drug/alcohol test (cleared) and impounded truck from the scene for inspection (returned next day ....passed ok)

A lot depends on the jurisdiction in a fatality. To wait 10 hours or more to drug test the CMV driver is crazy. Or anyone involved for that matter. (Regardless of fault). But, a messy accident scene can be hectic, and, I can see where drivers can slip through the cracks. Especially in a multi-vehicle pile-up involving 10-15 vehicles.
