Advice for a driver in a bad situation...

    You need to get your back pay , now !
    Before he goes bankrupt and you get nothing .

    just have a friendly chat and say you gotta have the money for your rent or living expenses etc , and you earned it and you want to be paid the back pay and going forward you need to be paid in a timely manner .

    how many other drivers are owed a lot of money ?

    how many creditors or credit card or bank loans are owed money ?

    Are the truck payments and insurance up to date? Or are they behind ?

    is it his truck or yours ?
    If it’s his , you might want to stash it somewhere (not your house ) and just go sit in his office and not leave until you get paid , if he balks then tell him the truck doesn’t come back until you get paid, and “screwing me out of $10k means I won’t have any choice except to file a complaint with the state labor department and the state DOT .

    the state likely won’t be much help for collecting back pay on a illegal 1099 job .

    your “friend” is fixing to cheat you out of a lot of money . Real soon .

    Yeah, rent a U-Haul or whatever you need and hit the interstate for Orlando, FL
    Keep it simple, protect yourself and high-tail it for Orlando.

    I think this is the winner here. OP, if your boss ain't paying you now, that money is gone. Since you're moving to Florida, the best advice I can give you is not to pigeonhole yourself when looking for your next job. You've got some experience so you should be able to command some decent coin. Be prepared to try a different sector of trucking outside of flatbed if need be.

    Talk to a lawyer. If sending them a certified letter demanding payment doesn't work, call the AG's office or the Texas Workforce Commission. And if you really want to play hardball, call the Comptroller's office or the IRS.

    As far as work, you can definitely find another job with 2 years' flatbed experience. There are probably lots of Moffett jobs in parts of Florida where there is lots of building or remodeling.

    If/when you move back to Florida....

    move somewhere on the NORTH side of the I-4 corridor....if possible.

    This will leave you with more potential CDL job opportunities later. :thumbup:

    Just south of jax in St John’s County , there is an entire town being built ,
    7000 homes , three schools , etc

    driving through there lokks like those old pictures from right after WW-2 in Levittown, where they had dozens and dozens of houses in various stages of completion as far as you could see

    As many said, above, time to leave, now.

    I worked as an O/O with a company whose owner had one of his largest accounts with his friend from High school.

    After awhile payments began to be delayed from the friends company, overdue 30 days then 60 then 120. They didn't want to go hard ball because this was their friend.

    I told them many times a friend wouldn't be delinquent on payment and not be standing in front of you telling g you why and how they will catch up and when.

    Sure enough the friend folded his company and walked away, $450,000 CAD was owing. The friend had a nice new 1 ton truck, nice house etc, that they couldn't touch as the debt was on the limited company that was just put into bankruptcy, with no assets of course.

    They ended up out of business as well as they couldn't recover from that.

    As I said, leave now, make your move back home and as an experienced driver you will be fine. Staying you are risking your income and your drivers license, for no reason.
