    I know in aviation, there is an exception to the ageism rule and thus they can force older pilots to retire. Is trucking like that to?

    No age discrimination in trucking. There's drivers in their 70's graduating from CDL school and hired immediately.

    so changed places at 55.

    but,I also have a good clean record.

    "The plaintiffs are asking for an award of lost wages and benefits, back pay and front pay, liquidated damages, compensatory damages for emotional pain, suffering, inconvenience, mental anguish, loss of enjoyment of life, punitive damages, interest, attorney’s fees and court costs."

    Really, emotional pain, metal anguish, loss of enjoyment of life....haha....i think they would be taken more seriously if they dropped some of those.

    That'll never fly as they state they were in the wrong. When a company pushes you to do something wrong and you comply then you are just as guilty as them.

    The first sentence is almost like saying that drug dealer ripped me off! I want my money back? The law doesn't help people engaging in illegal activity. If they refused to falsify and was terminated it would be a whole different story.

    I wonder about age also as I am 60 and thinking about getting a CDL and try to land a trucking job. I heard some companies may prefer some older people, maybe more mature or a good work history.

    This had less to do with age and more to do with tenure. The drivers in this case were the most senior in the company. Their claim that the less tenured drivers were retained is correct however, the younger drivers did not have the same amount of violations that they had. The punishment's ranged from 1 day suspension to termination.

    Truck drivers file lawsuit claiming age discrimination

    SHERMAN – In an attempt to be reinstated to their former positions, several truck drivers have filed an age discrimination lawsuit against a Plano company. The men argue that they did not lose their jobs because they falsified their time logs, but because of their age.

    Claiming violations of the Age Discrimination in Employment Act, Spencer Kevin Weddle, James E. Farley, Gary F. Phillips, Michael Grimes and Brian Bull filed suit against Safety-Kleen Systems Inc. on Jan. 12 in the Eastern District of Texas, Sherman Division.

    Prior to their termination, the plaintiffs were over the road truck drivers and hauled hazardous materials for Safety-Kleen for a combined 68 years of employment.

    According to court documents, the men were terminated for falsifying time logs while younger employees with the same violations were retained. The men argue that they were following the instructions of their Safety-Kleen management on how to keep the log books and how to make their driving runs on the defendant’s schedule.

    The plaintiffs are asking for an award of lost wages and benefits, back pay and front pay, liquidated damages, compensatory damages for emotional pain, suffering, inconvenience, mental anguish, loss of enjoyment of life, punitive damages, interest, attorney’s fees and court costs.

    The plaintiffs are represented by Joseph H. Gillespie of Gillespie, Rozen & Watsky in Dallas. A jury trial is requested.

    U.S. District Judge Richard A. Schell is assigned to the case.
