Good morning folks. So as a PSA, this is an update on a situation that I posted about last year. Here is the original thread:

King Heaven MC #1368706 owes me $3300. Bond canceled.

I went after Amazon since they were the original shipper and receiver, so they were the ones who benefited. Two days ago I received an email from my collector stating that Amazon paid the remaining 50% on the 26th, and that they will cut me a check on April 10th.

I'm sharing this because there is a misconception out there that going after a shipper is a waste of time and money. NOT TRUE. I didn't have to shell out a dime. The process took 10 weeks. Hopefully, this will encourage others who have been scammed to go after the shipper. And hopefully, shippers will be more willing to deal with owner/ops instead of just with brokers. When a shipper gets fed up with having to pay twice, they will begin to open their eyes. Good luck to all.

Baxter Bailey & Associates. They're out of Southaven, MS.

I took the lazy way out and just contacted Baxter Bailey and they did the rest. I had to send them the original ratecon, pod/bol, invoice, and pictures of the dropped trailer with the seal intact. I also sent them screenshots of all email and text correspondence between me and the broker.

If I would have just filed a small claims here in Nevada, I would have saved the 30% collection fee. Their fee for 3rd party collections is 40%, but they will lower it to 30% for your first case. But I thought it best to familiarize myself with the process before doing this on my own. When that time comes, I will first send a demand letter to the shipper giving them 14 days to pay. Usually they will comply because it would be cheaper for them than to have to go to court for such a small amount of money. Especially if the venue is a few states away from their home offices. After all, they ARE ultimately responsible for payment to the carrier. So if the agrieved carrier shows all the evidence in the demand letter that confirms that his obligations were executed, the shipper will usually just cut a check.
