Amtrak Train Derailment After Hitting Dump Truck

    The railroads do NOT pay for the crossing signals
    The county or the state has to pay for them .
    Is about a quarter million per crossing to instal the signals and arms

    never gonna happen on a dirt road .

    they usually install arms after two fatal accidents at the same crossing .
    Sadly , that’s the criteria that is normally used to decide which crossings get the quarter million dollar arms .

    One thing is for certain-MoDOT is in the hot seat for this one along with the dump truck owner!

    I won't argue with what your saying but why does the RR have to maintain the gates & signals and not the county ? .. because I've seen the BNR replace & repair the gates & signals
    Or is it that since it's a county road they have to buy them but the RR maintains them because of liability reasons ?

    Maybe it depends on the contracts. In my hometown Metra provides commuter rail service to a certain point but the crossing gates,signals,etc. are maintained by Canadian Pacific.

    What a mess..dump truck driver family suing the county and bnsf for negligence and bnsf & amtrak suing the dump truck company and families on the train suing amtrak…

    It will come down to what ever the NTSB finds in their investigation..
    Which we all know it will come back inconclusive.. but they will make sure the BNSF has no fault because one hand wash's the other
    Personally hope the court awards the dump truck driver's family millions and each passenger on Amtrack 100k
    And the court forces BNSF to update the crossing and hopefully Amtrack is forced to file bankruptcy due to the settlement

    Problem with amtrak is, they’re primarily taxpayer funded..

    I knew this was coming. I figured it would be a 3 way battle between BNSF,Amtrak and the trucking company. However,I’m surprised that MoDOT isn’t being dragged into the fray(yet) since it was revealed that they knew this particular crossing needed to be upgraded for some time!

    Give it some time once the law firms start digging..im sure they’ll be more than obliged to add them at later date..

    That’s a given. Heads are going to roll. Wouldn’t be surprised if all the hotshot lawyer firms in KC,STL and to a lesser extent Columbia try to get in on the action!!
