Yes they can go that fast-even more if the ECU is reflashed, removing the governor. Depending on the model most BMWs will be equipped with a inline six, either naturally aspirated or turbocharged.

Why am I not surprised that the BMW was racing a Mustang, the other of the two of the biggest status symbols on the road.

His statement to police that at one point that he hit 183 to police, tells you clearly all we need to know.
This kid is an accident waiting to happen no matter what he gets In!

The car might be up to the task but drivers are not up to the task of dealing with others traveling at that speed.
Watch some of those idiots on sport bikes smashing mirrors thinking it's the car drivers fault. They approach into a tight area at 4 times sometimes faster than the average and want to blame everyone else for approaching so fast others can't react quick enough.
Simply put within a few miles of the speed limit that car making a lane change would have been able to spot them and most likely have been able to judge thier speed and make a safe decision to change lanes or wait but approaching 25 to 35 mph traffic at nearly 90mph they appear to be coming out of thin air to the average driver.
170 + on the highway would have many divers in a similar situation.
