Well when he let loose he was a former cop yada yada yada they just gave him a good reality chk.Good for them cause he sounds like a jerk.I would'nt worry about the DAC or being sued.Some law enforcement like to play the intimidation game.Knowledge is power.![]()

I believe I will have a problem getting a shop,mechanic,or engineer to get involved as far as giving me written documentation. Most don't like getting involved with legal matters, b /c they may have to go to court, testify,lose pay from work and the like. I spoke with one person who disagreed with his stance and said customers have driven many miles with one bad injector. He said all it would do is cause the other injectors to work harded. I believe this is bs, the o/o could have stepped in at any time...he was in the truck as well. I even noted loss of power on my log book,as well as telling him.

So your boss is saying that you take full responsibility of the reliability of 12 year old truck simply by going on duty with it? And by taking it back from a shop that just worked on it, that you are liable if someone else's work damaged the engine, and you must predict the future that nothing will go wrong? Your boss sounds like he is poor, uneducated and has to blame everyone else but him. I have never heard of anything so outrageous. I am not a lawyer, but without a mechanic testifying one way or another on court, it is still your word against his. As long as you were only doing your job, which you were, I don't see how any judge would see you as being liable for what happens to an old, worn out truck.

Like a credit file but a driving record for cdl drivers. often companies put false information and "blackball" drivers with cdl's.

I don't know what state you are located in. You need to go to the Labor Relations Board of the state your boss is located in and file a claim. First they will establish that you are an employee and not a Independent Contractor. You were under direct supervision of your boss at all times, did you pick the loads you were going to haul or your boss? Did he decide everything..........if so you are an employee.
If he was in the truck and he paid the bill to fix the truck at the first shop then he excepted that shops work and the truck fit to work, regardless of your logbook status. -
Hey Gixxer, I feel for you guy, you seem like a straight shooter. I'm surprised your "good buddy" hasn't blown an injector being the stressed out DHead he seems to be. Even at .34/mi it seems your being shorted $700 for your 3K week, hope you have your log, because I don't know of any states that look to kindly on stiffing an employee on payroll. Now as far as the 1099 argument, I don't know how long you have been driving for him,but if he hasn't shipped you a 1099/W2 yet and you have your log I would pursue it with the state because I'm for sure certain your not independantly wealthly. Just my 2 cents worth.

Not wealthy . I told him I had a vehicle payment on the 13th of February. I'm probably going to lose my vehicle. I would cut my strings and be done with him but he's threatening to sue. He was in the sleeper when the company and I took care of payment for 1st shop. He paid the 2nd shop and still had it towed to the 3rd shop.
There were no signs the truck wasn't fixed untill it knocked and shut off. -
First week- solo
2nd week -team
I ran out of fuel on first week on Sunday b/c he told me not to fuel until after midnight Sunday....Then he changes it to he said not to fuel if at all possible.
Did not pick loads and wanted to go home 1st weekend but he wouldn't let me. My vehicle was in another state. -
So he was a former officer, big deal. I was an officer for 30 years before I retired, and you need to know that the average officer knows very little about civil court, just criminal courts. He is just blowing smoke, I bet he has probably been a bully most of his life and has found out that a lot of people run scared when it appears that someone has some kind of legal knowledge/skills. As said before, his hopes are that you disappear and don't ask for any money for fear that he is going to unleash some kind of suit on you. He's most likely bluffing unless he is some kind of nutjob.
I bet he has a good story on why he is a "former" officer. Most likely because of the same skills he is exhibilting in this situation.
