I think his best defense is that he was woefully ignorant and way to inexperienced and under trained to be placed in that situation and that he felt pressure to do what he was told for fear of losing his green card. All of which would likely be true

Just wait until we get 18 year old foreigners
From other countries behind the wheel of
    80,000 pounds.
    Can't speak the language,
    Can't read the signs,
Pushed thru a crooked CDL school,
    No training whatsoever,
Just throw them behind the wheel of some
    Foreign owned outlaw company.
Gonna be real exciting out here then.

Im guessing the focus is going to be on him not using the runaway ramp. I cant see a jury convicting him because he closed his eyes when he thought he was going to die. Its not like, at that point, he had any options that would not end in the death of himself or others.

I wonder what transmission he had. If it was a manual, the auto freaks will say this could all have been prevented with a auto and manuals will be illegal after 2020

Sounds about right. I did see a video of the sheriff or someone saying that he wouldnt comment on the kids attitude during questioning. It seemed to me that he wouldnt have even mentioned it if the kid was remorseful. Thats just my take on it tho.

I just did a search, the FMCSA requires the test be in English, but there appeared to be all kinds of study guides and practice tests in Spanish, I expect the understanding English to be enforced better, seems it was relaxed several years back.

On another note, I lived near a bad wreck on a secondary hwy over 20 years ago, that driver was from India out of Stockton, California, and he was said to speak English well by his company, but he forgot how during the excitement.

Steep hill, narrow bridge, wide farm equipment, no one got killed, but everyone was lucky that day. 6 month old Pete totalled out, frame rails twisted badly and other damage to components. Those guard rails and posts hadn't been safened up by weakening the posts.

This has me wondering. When people post about what to do when they get a ticket, the typical advice is to fight it even if they're guilty. Is there much difference between that and forgetting how to speak English?
