Are 2 points worth fighting?

    I got a ticket for going to soon after a crossing guard had her stop sign up. Questionable ticket. The police officer gave me a ticket for failure to obey an authorized person directing traffic. He assured me there were no points. Then I got a letter from Penndot saying I have 2 points on my license. I was in my personal vehicle at the time. I emailed the cop and said what gives and he said request an appeal (I already checked guilty on the ticket and paid the fine) and they may remove the points. I have no other points. My question is it worth it to take 2 days off to fight this, since I rarely get tickets and this will fall off in a year. I have no plans to apply for a job in the near future. I deliver fuel oil, with a class b and hazmat. So is 2 points on my Cdl a major problem? What are your opinions. I am from Pennsylvania. Thank-you

    I would hire a lawyer. ANY points is enough for a company to fire you. Hire a lawyer and get it expunged or knocked down to a non moving violation ASAP.

    Stays on record for 3 years. Yes, I would try to get it off. Anything can happen where you get fired, company closes, or sells. Things happen. I got fired not cause of a accident or tickets. Just a policy thing and was able to get a good paying job ASAP cause I had a clean record. Just had to explain my situation but cause my record was excellent the company I'm at took a chance on me. My job I lost was a union job too. You never know.

    You have already copped a plea and paid the ticket. Fighting this now will be like trying to climb up a fire station pole lubricated with lard. Try to get it expunged if you can but honestly when you cop a plea and pay a ticket it is almost impossible to get the case reopened.

    Major problem?

    No it is not, we have truckers with reckless driving tickets on their record so I would just disclose it to your employer and not worry about.

    Every point is worth fighting over. This is your career, not just some job flipping burgers. Don't sign #### ever again. I would also seriously look at keeping a firm on retainer. I have 7.50 taken out of every check for CDL defender. Short of a DUI, the 7.50 per week retains them for any related purpose for free. That's in a cmv or personal vehicle. Well worth it should I ever need them.

    Getting a ticket reopened is not that hard. Generally.you write a letter to the Judge asking him/her to reopen the case. Explain you are a CDL holder and were not aware of the full ramifications of pleading guilty on your enjoyment and career You acted.on the advice of the ticketing officer but not an attorney and request the case be reopened and a hearing scheduled.

    As for whether the points will hurt you, probably not for that offense, but weigh the options and see if in your case it is cost.effective.to have it knocked down.

    I once paid and $80 fine for a careless driving ticket in NJ. My employer flipped out... Can't drive here with a careless. Wrote the judge, had the case reopened, hired an attorney went to court, got it knocked down to an Unsafe Driving Charge, no points.... BUT... The Fine went to $432, add other attorney fee of $750 and I ended up paying almost $1200. The Kicker is, the only thing reported to Delaware was the Carless so I carried the 2 points on my license for 3 years anyway.

    Got tired of fighting the red tape, had the court summary from NJ showing the actual disposition so It wasn't an issue when I changed carriers.

    Look at all sides and unless you are planning on leaving where you are, and if your employer is OK with it, decide if it's worth the expense.

    What I usually do is head straight to the local barracks and pay the #### thing on the spot, preferably within a half hour.

    The system chokes on itself and treats it as a gift to the PD rather than a punishment to be assessed. Nothing more would be said anywhere in my experience.

    At one time I had around 8 points, enough to suspend the class A back in the day except a judge knocked a point off. In a few years that went bye bye.
