*Question 27: Would a driver who prepares his/her log on a computer, 'digitally' signs the log, and then transmits it directly to the carrier, be in compliance with 49 CFR §395.8(f)(2)?
Guidance: No. The driver's activities must be recorded in accordance with the provisions of §395.8(f)(2). This section requires that all entries relating to driver's duty status must be legible and in the driver's own handwriting.
*Question 28: May a driver use a computer to generate his or her record of duty status (log book) and then manually sign the computer printouts in lieu of handwritten logs?
Guidance: A driver may use a computer to generate the graph grid and entries for the record of duty status or log books, provided the computer-generated output includes the minimum information required by §395.8 and is formatted in accordance with the rules. In addition, the driver must:

1.
Be capable of printing the record of duty status for the current 24-hour period at the request of an enforcement officer.

2.
Print the record of duty status at the end of each 24-hour period, and sign it in his or her handwriting to certify that all entries required by this section are true and correct.

3.
Maintain a copy of printed and signed records of duty status for the previous 7 consecutive days and make it available for inspection at the request of an enforcement officer.

Can't use a rubber stamp, either, for the signature.
Question 2: May a rubber stamp signature be used on a driver's record of duty status?
Guidance: No, a driver's record of duty status must bear the signature of the driver whose time is recorded thereon.

autocar. the 2 questions actually somewhat contradict each other. but in reality the government has made it legal to sign any documents with digital signatures, it has been upheld in several court cases.
but iregardless of all that, my logs get scanned by trippak to my carrier, thus they get a copy that doesnt have have a original signature only a copy of an original signature.
then all i am required to provide to a dot officer is a COPY of my original log. i dont have to provide the original with my actual signature.
so exactly who am i required to give the originals to???
the signature i use is an exact copy of my signature, and since i am only required to produce a copy of my log, thats what they will get.
because you know i mail the originals home everyday as soon as i make a copy of them.
wonder why an eobr driver doesnt have to sign theirs. -

that's right autocar. the answer is there. and it totally contradicted your NO answer
the correct answer lies in autocars regulations quote. and the answer is YES YES YES YES YES.
a computer generated form. just like the 3 software programs available today that some of use.
don't know about the digital signature though. i just sign mine. -
$50 is a small price to pay for an actual program though. and would work much better. besided daily driver and eclipse. i like trucklogger much better.
VisionLogistics Thanks this. -
The first two guidances contradict each other.
Typical. They got you either way if they want to screw you.
The end result is the the same and there's no way to tell just by looking at the copy on screen at the carrier's place of business or printing out a paper copy other than my signature will be exactly the same if you compared copies from different days.
My view is if Obammy can shovel fake birth certificates down our throats, I can leave a time consuming step out of my paperwork chain. I'm just a driver not a president.skateboardman Thanks this. -
thats my point semi crazy, i feel the same way. if all they want is a "copy" then i will give them a copy.

390.31 and 395.8 is the latest and greatest otherwise the company guys couldn't do elogs...
I electronically sign (with my finger on a touch screen) my logs everyday. I have had more than I level one and never had a problem. But, each signature is unique and is not a duplicate.
What they are saying is you can't "rubber stamp" your signature. Each has to be unique.
Just get a copy of drivers daily log. It's cheap and works great. There are zero limitations with how you log, if you get my drift. -
I've never had a DOT bear say anything about my digital signature since it is my actual signature, just printed out by the computer when I use computer logging via Drivers Daily Log.
