Are the tickets you received BEFORE getting your CDL reported to the CDLIS?

    It is not quite that simple. You can get your CDL suspended for 60 days if the 2nd offense is within 3 years in any type vehicle and because of the offense your state takes action against your license. Per FMCSA 383.51

    In a word NO! The CDLIS don't work that way. What happens is your DMV record before you get the CDL becomes your CDL record. The CDLIS only deals with making sure you have only one CDL and only one driving record. If there is a problem with your driving record you will NOT be allowed to get a CDL.

    Depends how the ticket is written. Cops can right you at state level or as a DOT offense. A "normal" (non CVSA cert) cop can't write you up on DOT/FMCSA stuff so they'll write you as any other car doing it. Most states have that CMV checkbox on the tickets and how it gets put through after the fact can change. But state level charges don't trigger DOT consequences, obviously where not talking about DUI's and stuff. In my home state of MA the state level charges is many times worse than the DOT offenses but it doesn't leave the state. It can work for you, or against you depending on the situation.

    None of my 10mph or under show up, but none of them have ever been in a CMV. Just an improper lane usage one (wrong way in a one way, downtown Tulsa in my pickup) and a 14mph over that was actually 9 over and I had removed, also in my pickup.

    There is a lot of confusion and pure BS out there about tickets, CVSA, CSA and the various ways you can get things on your driving record as a CDL holder. States are paid by the FMCSA to do CMV inspections per MCSAP. If a DOT officer whom is certified to do inspections cites you and the offense is on the form you will get CSA points plus a state fine to pay. If an officer whom is NOT certified cites you it is only a fine and is not part of any DOT action later unless of course if you have an accident then a certified cop will get involved. There are a lot of state weigh masters that are certified but have no police powers away from the scale. There is also a lot of officers that have police powers and are not certified. One more thing, a non certified officer can NOT put you or your truck out of service.

    Seems like lots of misinformation in this thread, I don't know if I can conquer it all.

    Tickets in your personal vehicle count against your CDL in every state I am aware of. It used not to be the case 20 years ago when separate records were accrued for both personal and CDL driving. Those records were merged some 20 years ago. Stupid stuff in your personal car can get your CDL suspended.

    Not only that, tickets that accrued prior to getting your CDL that are still on your record will often remain on your record after you get your CDL. Let me explain what I mean. In this state most tickets drop off a personal license record after 5 years. After 5 years evidence of the tickets may be hard or impossible to find. However, you get a CDL they stay on your record for 55 years! Thats right, practically your whole working life you have to explain for that ticket. I understand in this state, once you get your CDL any prior tickets still on your record at that time now get frozen in the 55 year loop. But that is just WA state. Each state is different in that respect, but I believe all states count personal tickets and CDL tickets on the same record.

    How FMSCA counts your ticket in the PSP or for your company is a whole another issue that is separate from your CDL license itself.

    Any company worth a #### is going to want an abstract for the last 5 years as a new driver.

    They already know you can't drive a truck very well. But if you can't manage to avoid tickets in your car, you're probably gonna be a problem in a truck too.

    NOTE TO SELF: NEVER MOVE TO WA......CHECK!

    Here in VA an employer can only see back 7yrs on a driving record and it's illegal for them to ask us to provide the "personal use" driving record which shows a lot more. Doesn't help with DAC or PSP but when your not an OTR guys those aren't really things you worry about.
