Arrested on a 34 hour reset, criminal mischeif.

    I was on a 34 out in Daytona Florida, planned on getting a hotel so I could hit some bars and have a mini-vacation. Been on the job for about 3 months.

    I over did it, was hitting on a lady bartender and just had too much to drink - blacked out. First time I've ever done that. Next thing I know I'm getting marched into county for criminal mischief; didn't qualify for a notice to appear because I was not a resident of the state so they had to take me in.

    I was in for about a day before I was released, made it out before my 34 was up - get back out to my truck to find that my co-driver had reported it to the company which resulted in immediate termination. Couldn't even ride back in the truck, they sent me back home via Greyhound.

    My question is - how bad is this? I'm currently waiting to see an attorney, fairly confident I can get this thing squashed. But I don't know how hard this is going to make it to find a new job.

    So what is the real question?
    Do you want to know how to log 'off duty, incarcerated'?
    Are you trying to claim 'detention' time from your former company?

    Sorry, I'm laughing because I remember a company I worked for that had 3 drivers arrested in the same bar, on the same night, years ago.


    All you can do is apply to the usual bottom feeders, cross your fingers, and if you get hired again, stay in the truck and watch tv on your layovers.

    I can imagine what your company is going to put on your dac.if you got fired work related your chances of finding a job are greater then this reason for termination.so with that said be prepared for many companies disqualifing you.I don't see nothing wrong with having fun on your 34 but I'm not your employer either.

    Well you were not driving when it happened you were off duty but still you were on the job so to speak.

    Most employers are going to look pretty negatively at someone getting drunk and arrested while they were supposed to be responsible for a truck. I don't have any specific info for you but I think this is going to make things hard for you until some time passes.

    for some reason I actually think the cops did us all out here a favor of taking this irresponsible driver off the road before he ever got the chance to mess up

    Having fun doesn't seem to be the issue.... Blackout drunk seems like a legitimate concern for anyone in any profession.

    Being arrested will be on your record for a long time even if you beat the wrap. So have a better story than this for your next job application.

    I should start with "I was stupid..." Include "I learned from this..." And, maybe throw in "I am deeply embarrassed by my actions..." for good measure.

    Black out drunk is alcohol abuse status and most companies don't overlook this.
