    The term in physical control, is being IN the truck, WITH the keys, and NO sobor driver at the wheel. Its the same definition for non cdl. The limits are diferant for when your driving a cmv, but the definition is the same...

    Now the comments come in like pouring rain.

    The way I read and understand the regulations posted from Exrayman:
    You can't have alcohol in the truck, can't leave or drive under the influence and can't even stay in the truck under the influence.
    That's why it's so important as I stated before wether the OP had a room to return to BEFORE he went drinking.

    Dont know for sure about the being in the truck drunk, that could be aginst co. Policy, but legal? If your in control of my car..... and im drunk, and your not.... im not getting a dui. And nither are you. If it was a solo truck. The act of getting in the truck makes it a dui. But a co driver makes it a sobor cab.

    Yeah, there is a word for that but if you type it here you'd probably get banned for life.

    I see tons of condescending posts on here and I would bet 90% of the people making them have done something worse than this guy did at some point in their life, yet you are still driving a truck.

    Street beater, you might be right. But I think many companies wouldn't take a chance and fire drivers in such a situation.
    Like I said, a confirmed or even a paid hotel room would save his butt. It'd evidence that the driver did not plan to get back to the truck in questionable condition.
