If any of this is in written form on an application it will hit the trash can quicker than you hit the bar room floor. It comes down to reliability and self control. When looking at hiring someone it is not only their experience in a truck but how the driver represents the company. Would I hire you knowing what happened - probably not. There are plenty of companies that will. Your problem will be getting past the gate keepers - ie, the insurance company of the trucking company. Good luck.

Just for the record even though you are off duty most companies want you to not consume alcohol while you are responsible for their equipment. Lots of drivers do it until they get called in for a drug and alcohol on the road. A positive alcohol is just as bad as a positive on a UA per FMCSA rules and requires a SAP return to duty process. On a personal note if I had owned that truck and you had worked for me you can rest assured there would be a notation on your DAC do not rehire. You showed irresponsible behaver and this don't go well with driving a CMV. My best advice to you is to determine if you want to be a drunk or a truck driver. If you want to be a truck driver stop drinking like that on the road. If you want to be a drunk then PLEASE PLEASE do yourself and the public a favor and stay out of a CMV!
Edited to add To use a term from the movie Top Gun on these kind of matters I will never blow sunshine up your butt. Be a bonghead or a drunk it don't matter. How about growing up and putting that childish behaver away. Driving a CMV in todays environment just don't suffer foolish behaver much and I fully support this. Like I said above make up your mind!Last edited: Jan 22, 2016

I don't understand, running team how could you need a 34hr restart. I thought teams never ran out of hours.

One more thing to the inevitable reply I know is coming. Yes you can per FMCSA rules tell the collection point of the Alcohol/UA place you are off duty and not have to take the alcohol test. This is 100% true. HOWEVER be advised that some company safety depts will never allow you to do this while you are on the road and responsible for their equipment. Just a word to the wise.

We have an old saying here in Florida .
Arrive on vacation.
Leave on probation.
Return for revocation .
Most likely the court is going to throw it out for court costs only.
Hire a local Daytona attorney to appear for you.
Chalk it up as a big lesson that could have been far far far worse.
If you lose control of your judgement while drinking with no recollection it may be time to reel it in.
Off the record and be truthful to the people here and to yourself, how many times have you blacked out while drinking?
And if you did we're there consequent s the next morning ?Last edited: Jan 22, 2016

As far as drinking and blacking out - this is the first time that's happened to me since I was a teenager, like 16 or something - over 12 years ago. So it's not like drinking has ever really been a problem before - I was just having too much fun, made the mistake of doing an all-day drunk - not pacing myself. You can believe me when I say, that will never happen again.tucker Thanks this. -
From my googling it seems that "Criminal Mischief" is just what FL calls Vandalism, and typically is misdemeanor. I wouldn't worry about it long term, what sucks is explaining to the next place why you got canned.
TBonze Thanks this. -
Well now that everyone has come to vilify you and judge you... All I want to know is how good looking the bar tender was!?
And why didn't you go back and try to stay at her place after you got fired? Who needs greyhound?! Just set up shop in the town, start dating said bartender and find a local job. Ha!
Anyway dude. Get a lawyer. A good one too. Not one of those hanky panky $130 get it off your record lawyers either... Then once it's cleared get back to trucking.
Yee haw!
But seriously? How good looking are we talking here?! Lol
