Arrested on a 34 hour reset, criminal mischeif.

    I vote for wrongful termination.
    He was off duty. If he had been doing his reset at home, got hammered, neighborhoods call cops for singing to loudly. Is this grounds for termination?
    No felony involved here.
    If everyone who got hammered on occasion during their down time was suddenly unemployable, or seen as someone with a problem, what would we do with all of our college graduates?

    I don't think the behavior was something I'd want to see, but, I agree, with some people, that since he was offduty that it shouldn't have been anyone's business.

    Furthermore, there was a co-driver. He wasn't responsible for the truck too? As long as they aren't both drunk, and no alcohol is in the truck, or the driver in the truck, I really don't see where the problem is.

    (When team driving, can a 34 hour restart be started/finished while the co-driver is still driving?)

    The difference here is he wasn't at home. He was away in another state with the care of the truck entrusted to him and the codriver. I don't care if my employees drink off duty but I sure don't want them getting pass out drunk when they are in charge of caring for my equipment. Off duty in the trucking world is kind of a strange situation. You aren't working but if you are with the truck out of town you are still responsible for it in my eyes. Now off duty at home and the truck is at the yard you can get smashed if you want.

    Who knows what kind of company policies his employer had and what he signed and agreed to when hired.

    I do tend to think the team mate was a snitch. I would not put my job on the line for someone else's shenannigans but I sure wouldn't be ratting them out for something that happened off duty until I had to. Meaning if this occurred to me on a 34 and my teammate was not there when it was time to roll I would call him in MIA but I wouldn't be calling in until I was left with no other choice.

    I could not have said it any better. Folks this is what orientation is for. To get answers to questions like this one. There are some smaller companies that may let you do this, but none of the mega carriers will. I challenge anyone to show me where this is not prohibited in your company handbook!

    LOL you guys are hilarious. Honestly man i dont see what you did wrong here. It sounds like you started drinking in the beginning of your 34 so i dont see any evidence based on what you wrote to suggest you are a dui risk. So you got a little drunk and said "inappropriate" things to the bartender. Am i understanding this correctly? If so im sorry but i fail to see how that makes you a criminal. At worse (and no offense) the bouncer/guard/one of the male workers should have kicked you out of the bar and maybe roughed you up a little to teach you a lesson. This is what happens when you base your society on matriarchal principles. Honestly i would hire you but im in no position to do that so yeah good luck, lol. You should be able to find work.

    It depends on what you were charged with. Most company policies state that you can't consume alcohol while you are in possession of their truck. Possession meaning parked anywhere other than their terminal. I'm an alcoholic and I have been sober many years. When I drank, I too was a blackout drinker and I did a lot of stupid things out there I have regretted. There are so many amends that I never got a chance to make because I wouldn't even know where to find these people. My solution was to make a living amends which means that I had to change the way I was living. I woke up in many jail cells from fist fighting over something that was stupid the night before, disorderly conduct, public intoxication etc. I also used to drive my semi when I had been drinking back in the 80's until I had a near miss. How I never had a DUI is a mystery to me. I can promise you this. It will only get worse. Blackout drinking is a sure sign of a serious drinking problem. You can overcome this legal problem but it will probably be noted on your work history for awhile.

    If you escape this problem with ease, you will more than likely be tricked by your own reasoning that it wasn't that bad...until the next time.

    I tried for many years to control my drinking and no matter what I tried, I failed. Today, my life is successful and I have no interest in drinking alcohol in any amount. Sober living is the easier softer way. It is so much easier to do my job because I am not in bed with a hangover or locked up somewhere.
    Do not marvel when I tell you this. If you need someone to talk to about this, you can contact Alcoholics Anonymous by looking in the phone book. There are people that have had similar problems due to drinking and they will help you. When I was drinking, the scariest thing that I could ever imagine was giving up alcohol completely. I didn't get into trouble every time I drank but every time I got into trouble, it was because I had been drinking.

    Now go do the right thing.
