At no fault accident.

    I was involved in an accident 02/17 in an CMV. IT was a cut off and I ran off the road into a ditch. No injuries. The truck was towed in result of The accident. The car never stopped. IT was night and I was unable to get the license plates. The Sheriff arrived and issued me a citation(failure to control) In which I fought in court and it was dismissed. I have no points on my license; however, the accident shows up on both my psp and license. I am having problems getting hired on with companies although it was an at no fault accident. Any suggestions. I have been driving 17 year with absolutely no accidents.

    Well, get over the idea it was no fault. It was. Just because the court dismissed the ticket means nothing.
    You did wreck. You were at fault for the wreck. Companies are seeing this wreck, you claiming innocence and knowing you were not. That is putting a sour taste in their mouth.
    Live up to the mistake (Swerving is an easy one to make, but the wrong move 100% of the time)

    The reason you were at fault.. You left your lane going into a ditch. As bad as it sounds, the correct course is to let the car hit you while standing on the brakes as hard as your load will let you.

    Try expungement. An attorney might be able to help too.

    If your accident was classified as a jacknife, that will make it hard for you to get a new job with good companies. I've been to a few companies that will fire you on the spot for jacknife or flipping the trailer. Did you damage the trailer and load ? Many companies will look at the amount of damage and use that to determin employment. If you went off the road, towed out, and have no damage, then there would not be any problems. I too went in a ditch but no damage and was towed out while working for Schneider, i didnt have any issues working for many other carriers afterwards.

    I was on a US Highway in the NE and an 85 year old lady pulled out in front of me from a stop sign. I swerved and pulled to the side of the road and she hit my left rear tire and walked away unharmed. If I did not swerve, she probably would have been dead from a head on collision. Drivers have to use their common sense.
    Should a driver stay in their lane and slam into a school bus that pulls into his path? No, he should swerve and go in the ditch if the situation calls for it.
    A dash cam always helps.

    At the risk of sounding cold hearted ...
    My family's welfare is more important to me than any other person on the road. If they wish to kill themselves by running into me that's their problem. Yes, I will do what I can to avoid it, but I will not put my family's livelihood at risk because they can't drive.
    I will stand on my brakes at hard as the load will allow, I will quickly change lanes if I can, etc.
    I will not, however, risk flipping my truck by going in a soft dirt off road to avoid getting hit by someone that cannot drive.
    As for the bus strawman, well it sucks, and in that case yes I might. No you went in a ditch for a car that can't drive and now look at your career. Was it her bad driving really worth it to you? Now think if you have family that you need to roof, feed and cloth.

    I'd like some clarification on this one.

    Since the OP was there and none of us was, and sometimes describing what happened doesn't really present the whole picture, I have to take him at his word that it was ditch the truck or kill the other driver.

    Are you saying that it would be better for him to risk killing the driver so as to not damage his career?

    Again with strawmen. There is 0% chance the most observent person will know if a wreck will kill someone while the wreck is happening. Heck, people have survivef 5,000 foot falls from airplanes. And some people have died tripping on a sidewalk.
    Too many variables to know. Is the driver wearing a seat belt? Does the car have side air bags? Is the seat adjusted correctly?
    Since there is no way to know know what will happen, yes her poor driving is less important to me than my family.
