Attempted Murder Charges for Trucker "Spy"

    It's very hard to do when this guy actually pulled out a gun and started firing at one of us. I've seen guys like this on the road doing the same things. He's not the only one out there by far. One of them even went after my mother years ago after I'd restrained myself from putting him in the ditch when he came after me. The cops these days seem to have better things to do than patrol the roads for blatant traffic offenses. All that boils to the surface watching this guy play the system.

    He's going for a plea bargain to get off easy, is what he's doing. Make the prosecutor doubt himself while drawing it out as long as possible. Then get off on a much lessor charge and basically skate free with a slap on the hand.

    Also, we're not too keen on a guy who discharges a firearm AT A MOTOR VEHICLE being allowed to walk free between now and his trial.

    Attempted murder guys usually are locked up pending trial.

    Well, at least they didn't move his next court date months down the road today.

    Chickamauga Man on Trial for Shooting Truck Driver by Mikaya Thurmond


    A Chickamauga man, whose job is to spy on truck drivers, is now accused of trying to kill one. It happened in 2010 and the case is finally making its way through the Hamilton County court system.

    Joseph Volpe sat silently in Hamilton County Court with his lawyer by his side. He faces several charges for a shooting back in 2010 after an altercation while on the job. The Chickamauga man is paid to observe truck drivers and catch them in the act of dangerous driving. But on June 30th, 2010, one truck driver says he took his job a little bit too far.

    Joseph Johnston says Volpe was filming him while driving down Interstate 24. When Johnston figured out what Volpe was doing, Volpe's attorney says Johnston used his truck to try running Volpe off the road.

    Sam Robinson represents Volpe in the trial he says "Mr. Johnston gave my client the one-finger salute," once he realized that he was being recorded.

    While Johnston admits to misbehaving, he testifies that that's when the situation turned violent. "He fired at the back of the cab of the 18-wheeler. While it's driving down the ridge cut. The shot goes from the back cab portion. Not the trailer, but the back cab portion through the sheet portion and the sleeping portion. Through the head rest of the driver," says Johnston's attorney.

    The defense maintains that Volpe was not the shooter. "Here's the ridge cut. Here's the 4th street exit. He said he heard a shot. Now this is east lake court a fairly common place for shooting but he did not see Mr. Volpe shooting," adds Robinson.

    Volpe is facing charges for reckless endangerment, aggravated assault, and attempted 2nd degree murder. The trial will resume Wednesday afternoon.

    Am I to assume he wasn't found with a loaded gun, or owns none?


    Even if he gets out of this, at the very least he's going to have to deal with a lot. And that attorney is probably very pricey. He's getting crap, and he deserves it.
