Background Check on Myself

    OK, I've recently gotten the bug again for getting a CDL and trying my hand at driving a truck to make a living. I'd looked into it about 6 or 7 years ago and got as far as putting in an application at Swift. Needless to say, I didn't get hired. Not sure exactly why BUT I've got a felony from 97 and another from way back in 91 or so.

    When I did the app for Swift seems to me they wanted me to list everything in my criminal history including arrests/convictions with dates.

    I met someone once (after I'd applied at Swift) who had a Q level security clearance with the military. We were out on a camping trip with a mutual friend and for whatever reason I let him know I had a felony. To my surprise, he told me that he was required to report his interaction with me. He told me that it wouldn't make trouble for him UNLESS he didn't report it. He just wanted to be safe. His explanation was that honesty and accuracy was very important to the people who do the background checks. From what he said, a person with even a somewhat checkered past could get clearance as long as what they told the investigators matched up with their records.

    Now that I've detailed what I'm thinking about, I'm interested in running a background check on myself to make sure that what I tell them matches up with my records. My past is something I'd rather forget. I don't remember the exact dates of conviction much less any time I was arrested for minor stuff and later released.

    I'd like to know the a service preferably THE service used by the majority of trucking companies.

    Ideas?

    I'm also looking for feedback from some of the more experienced people here. Is what I'm planning a good idea or do you think it might freak them out?

    The newest felony is 14 years old. In most cases that is old enough to give you a chance. Still anyone with a checkered past won't have the same opportunity as those with a clear past.

    With a second felony conviction, I really don't know what you could expect. My guess is with two convictions and possibly other arrests, you will be very limited if you can find anything.

    If these violations have anything to do with drugs or alcohol then it gets harder. If they have anything to do with theft or violence then it gets harder.

    These violations keep you from being able to enter Canada. Certain violations will cause you problems with, or prohibit you from getting a Hazmat endorsement.

    The only way to do a comprehensive search of your criminal history is to access the NCIC database. This is a database maintained by the FBI and started more than 40 years ago. You will be surprised by the detail in this; I saw mine from when I was in the military. They know when you get a passport; leave the country and all arrests.

    I don't know what kind of information you get from the companies that charge $14 - $20 to search a national database, but I'd guess they don't use NCIC. This database is for law enforcement but some security companies have access too. I did a Google search and ehow dot com had a good article. Here is what they say about getting access to your NCIC file and I wasn't aware of this:

    Make a request to any local law enforcement or criminal justice agency to access any information about you in the Interstate Identification Index III File. If you have a criminal history that included being fingerprinted, and your information is included in that file, you have a right to review those records.

    Present appropriate identification in accordance with the applicable state, federal or agency law where you make your request. Appropriate identification includes being fingerprinted by the agency to which you make the request

    Request that the law enforcement agency retrieve the record from NCIC online--if it has your fingerprints on file locally and the FBI identification number of your record is available. The local agency can also send a written request to the FBI in Washington, D.C.

    Tell the agency--if your fingerprints are not on file locally--that you want the fingerprints you submitted for identification purposes sent to the FBI or a state central identification agency for comparison to the prints in your existing record. Once a match is verified, you can access and review your file.

    I don't know if there are other ways to gain access to these files or what the trucking companies use to check our records. I tried to get information from HireRight but between their double talk and the language barrier it was not too fruitful.

    If I were you I would try one of the companies that sell you this service, if you don't want to play with law enforcement to get your NCIC records. I doubt you will find a starter company that does training that will hire you. I would run a check and find out if I could get hired first. Then get the training at a college of some kind.

    Not sure what is searched, but I had to go to my county court house to get a criminal background check done before I could goto CDL School. If I remember right it cost me 25.00 dollars. Mine was clean with nothing on it at all, and it took the lady 5 minutes or less to do it.

    Most trucking companies go back as far as 10 years,most required felonies be more than 10 years old,now that being said even tho if you have a felonies 10 years ago or longer,they still may not consider you,it all depends on the crime.Now since after 9/11 trucking companies gotten very tough about that,felonies.I have heard and read of people with only 1 felonies on there record that 15 years old or older and still couldn't get hired.I believe it all depends what the crime was.

    First you should know why your friend said what he did. The military people do not hold Q clearances so your friend must be a civilian working for the military. He said what he did because he is in what the military calls the PRP program or Personal Reliability Program and he is protecting himself. The location of where he works requires more than most places and what they have done in his background check it's highly unlikely they will go as deep in yours. When he got his clearances most likely he got a Background Investigation or what is called a BI. They are done or were done by the FBI and they cost in the thousands to do. Mine took 6 weeks to complete and I was only 17 at the time. So do not base what your friend goes through with what is a standard check the trucking companies do.

    However, anyone giving you advice as to lie about your background is doing you an injustice. If a trucking company catches you lying on an application they will fire you right there and most likely report it on DAC and you'll never find a driving job. It would be very smart to get your old records and get the dates right and for what the offense was. You can either contact the police department or the courts where this happened at.

    Trucking companies are not going to ask if you've ever been arrested (I've never seen one) they are going to ask if you've been convicted of. If you get arrested and found not guilty then there should be absolutely no repercussions in any form.

    You can check most of the time on-line to see which companies accept felonies and how long ago. There are many that take one but two you may have a problem. Maybe you could talk with the court and have something done about your record. It doesn't hurt to ask and just explain that you want to drive a truck and it requires a background check.     You can also call HireRight and they'll mail you a copy of everything they have on you (DAC, background, etc.) free of charge . Make sure you mention you want all of it, not just one section.

    GasHauler (and others) is giving you great advise, though - don't lie about it.

    By the way, I don't know if most companies use HireRight for the background, but I think many use them for the DAC - so it would seem logical that HireRight also supplies the background. Don't quote me on it, though.

    Thats funny but hey, I personally appreciate the word on HireRight,,checking out the website now... I was told today that I had something on my DAC that I did not know was there...
