Background check question

    I wanted to know if anyone knew if a sealed record would show up on a DOT background check. In 2009 I had a minor misdemeanor conviction for possession of marijuana a ticketable offense not punishable by any kind of jail time. I had the conviction sealed in 2012 but while at orientation my instructor told me that we had to fill out an official application and that we had to list all convictions regardless of being expunged or sealed. I did list it because I didnt want them to think I was trying to hide anything but I dont think they can hold a legally sealed record against me can they?

    Doubtful. Not sure what you mean by DOT background check unless you're talking about for hazmat but then even it shows up it may be disregarded. Some highly sensitive cargo carriers will contract for background checks where this would most likley show up and be an issue but otherwise, if the judge didn't lie to you and his clerk handled it as they were supposed to, you should be ok with the typical pre-employment screening check(s)

    Yea it was just a federal background check they said for pre-employment because they said they only do a state background check before you get to orientation and then they proceed with a federal one and thanks for the info.

    ohh and i know it has been sealed there is no record of it on the courts website and I have an official paper from the courthouse that is notorized and signed by the prosecutor

    Working as a truck driver, as far as background checks are concerned, has practically become the equivalent of working for law enforcement, U.S. military, corrections, along with various other safety & security sensitive jobs as being in a nuclear power plant or the C.I.A..

    Personally, I believe that you made the right decision. This way there is no question about your honesty and integrity in any shape, manner, or form whatsoever.

    Actually depends on the State. Some states will tell you not to divulge info if it was 10 or more years. Your time is within the checkable timeline even for those States that don't have to self report so.......

    You should know before orientation is over one way or the other.

    Yea thats what I figure I filled that stuff out on Monday but they haven't mentioned it or anything but when I listed it under convictions I also put in there that it had been sealed and I had documentation from the court to show that.

    Ya know what? F' them if they bring up a sealed or expunged record. Its not any of their business. DO NOT report it and if they bring it up go to a lawyer. They are just trying to intimidate you from the get go. Quit letting these companies push you around!

    Yea i kind of thinking they couldn't legally hold it against me if it was sealed but i did report it to them already because I just at the time it was kind of a split second decision but I will just have to see what happens i guess

    Keep us posted. I have a felony record that was sealed last year. I received a letter from my lawyer and it said the only time I should admit it was if I was applying for work within the education, health,ect... and if I wanted to enter a port in the state of Florida. The letter said that the grant to seal had been sent to the county of the arrest, the Florida Dept. of Law, and the FBI. Now my felony will be 10 yrs. old in a few days, when I call a company or school to see if I qualify I still reveal the sealed felony. If I tell them about it then I dont have to worry about them finding it. I find that being honest just puts my mind at ease.
