Bad start to a new year

    And you couldn't get an extension? We have 4 trucks to run until 2015 and 16.

    Read somewhere OOIDA is filing a lawsuit against California; something to the effect that California can't regulate out-of-state trucking companies concerning issues such as CARB due to interstate commerce laws.

    calif has their bases' covered, so to speak,..you can try all your work arounds but they will catch up to you sooner or later and they like to "retro" fine you..They will hit your tax return 1st.. then your BOLs.then your trucks paper trail....then... well you get the point.they build snowballs with your info..

    I dont know if you are referring to me, but the only way I know to get an extension is thru what they call "good faith effort". Where you can get an extension if you have proof of intent to upgrade the trucks in your fleet, even with that there is a percentage of trucks that must comply with this year's deadline.

    they arent trying to regulate out of state trucks..only those that come into this state...thats how they "work around"

    Just talked to a driver from California..(owns his own truck).......

    He was explaining this..If you are an independent owner-operator, You can get a waiver exonerating your truck from ther CARB compliancy...

    But he said you are only allowed 5,000 miles per year in California..

    Im going to look into that some more

    It is being challenged by OOIDA and it will be interesting to see how it turns out (http://www.overdriveonline.com/carb...etrofit-requirement-in-emissions-regulations/).

    The same type of challenge got rid of the coil endorsements that Alabama had for out of state trucks. They ruled that the requirement that Alabama had was preempted by Federal law (http://www.fmcsa.dot.gov/rules-regu...otices/Alabama-Metal-Coil-Securement-Act.aspx).

    The Alabama law only applied to trucks that came it to that state as well.
