This is a sign of things to come ...

With enhanced regulations coming this year, and into the future - many types of conditions will be disqualified from commercial driving.

Diabetes, and breathing conditions will be the first targets, then excess weight.

It's already happening industry wide with more strenuous physicals, and increased insurance concerns.

Wouldn't be surprised to see the big carriers start to ban smoking as well.

Especially the best carriers (Walmart, UPS, etc) - with the best insurance.

    Best of luck!

    Call an attorney.

Local OTR company said that 60% of their drivers won't pass the new regs. Maybe that will turn the tables of this situation.

Not so much! In today's world, an employer can fire at any time for any reason, or no reason, and probably get away with it! Laws only protect the folks with the most money. Besides any company, if they need to, can find dirt on any driver, if they take the time to look hard enough!

They hired him knowing about the Cpap. If the official reason is the Cpap he can sue them. Their stated reason for letting him go is binding. Can't change it down the road.

I'll agree with you there. But they wouldnt be so stupid as to put anywhere on paper, or in a way that could be proven, that the CPAP was the reason for termination. They would lie and make something up first!
I worked for them and they knew about my CPAP. We clashed about idle times too but I left them for other reasons. I expect that they would have fired though as my idle time was over 60%! Maybe if they used brokers to find freight in their dead zones (their sales dept couldnt find a freight contract in St louis for example) I wouldnt have sit 3-4 days at a time between loads!

They should have given the driver a letter of seperation. It would state the reason for termination.

yes I also worked for Barr Nunn, was a great job until we lost our salaried positions... Then it was quickly reduced to Burger King like pay... Another example of a company gone to pot when the person that started the place retired. (Bob Sturgeon)

Aint that the truth! once he quit going to work every day it went downhill fast! Not to mention, the people responsible for ruining, oops, I mean running his company, couldnt tell the difference between a STEERING WHEEL and a FIFTH WHEEL either! Just a bunch of college-educated bean counters who hated all blue collar people and treated us a secondary citizens, fit for only menial labor! No, I'm not bitter at all!

Barr-Nunn sucks, they would rather have drivers sit , than use a freight broker. They are after big $$$, and they'd make less if a broker had his hand out for part of it. But the thing is.... it wouldn't be the huge profit, but they'd still make a profit if they used a Broker. They are GREEDY and the drivers mean nothing to them, we are lower than dog ######, so they have no problem making a Driver sit for 3 - 4.5 days waiting for the next big $$$ load. Also, in BN's eyes, that fuel is much more important than the Driver, so get all over his ##s if he idles, write him up, put him on probation, and eventually fire that Driver if he " wastes " fuel to stay warm or keep his C-Pap machine running ! They sure won't put in APU's either, they cost big $$$, and that's all they care about, the almighty $, NOT the Driver ! They also fire Drivers after they've had a few raises, and just before they are due another raise or bonus or vacation. They're now hiring Drivers at a LOT less $$ than the experienced guy is making. They fire the experienced guy, he doesn't get his upcoming vacation or bonus, and bring a new guy in at 5 - 10 cents less per mile. They are selfish, greedy scum !!
