Primarily working overnight shifts, deliveries from our distribution centers are made during overnight hours in order to deliver freight to our company-owned branches before they open. Occasionally, Fastenal also employs Over the Road Drivers, Team Drivers, Relief Drivers, and Freight Terminal Drivers.

Yep that’s the way to go.

Collect unemployment and hang out until the baby is born and things are under control.

No written warnings, didn’t sign any warnings.

Also, OP, you may want to check your state’s unemployment website. They usually have a job listings website that pulls help wanted ads from various other websites. Lots of listings without having to sort thru the craigslist riff-raff. The ads are typically paid and the advertisers appear to use a spell checker at the very least.

I would challenge it by filing a report with hire right and force us Xpress to come up with physical evidence to support their claim or by law hire right will remove it from dac

Try a driver staffing company. They are far more forgiving and the company they assign you to rarely asks for your safety record. I was turned down once in 15 months. Trillium is a good one, or Pro Drivers, etc.

Pretty sure you are allowed to touch your phone if it's in a cradle on the dash. How else can you turn on an App? You can't text with it, but you can touch it, at least I do.

The actual law stats you get one button press...Doesn't really matter though as the company can make more restrictive policies.

It's against the law for a former employer to state anything other than whether a former employee is rehirable, or not. (Edit... this is not 100% accurate. It's general policy... not law)

If USX is talking shizz... I'd send them a cease and desist letter else pending litigation.
