In order to capture the 4 seconds before the event, everything is being recorded. It comes down to where is the data stored and who has access to the data. Also, digital information can be recovered even if it is erased or overwritten in some circumstances. -
Well I have no idea why they can't produce the video but there will probably be a lawsuit. There is really no evidence but a video would certainly help everyone on my side of the table. Why it can't be produced is troubling.

Wouldn't it be required that he had gotten a ticket for using his phone while driving, for it to be on his PSP? A company can't just throw that on there. Or can they?

No to both.
A CVSA inspection is required, and a violation noted on it to go on a drivers PSP report.
No actual citation required.

You are able to dispute anything you believe to be inaccurate, just as you would with a credit bureau over inaccurate information in your credit reports. HireRight is subject to 15 USC 1681m just like any other consumer reporting agency. They straight up falsified information on my report with them.
