    Question 26: If a driver is permitted to use a Commercial Motor Vehicle (CMV) for personal reasons, how must the driving time be recorded?

    Guidance:

    a driver is relieved from work and all responsibility for performing work, time spent traveling from a driver’s home to his/her terminal (normal work reporting location), or from a driver’s terminal to his/her home, may be considered off-duty time. Similarly, time spent traveling short distances from a driver’s en route lodgings (such as en route terminals or motels) to restaurants in the vicinity of such lodgings may be considered off-duty time. The type of conveyance used from the terminal to the driver’s home, from the driver’s home to the terminal, or to restaurants in the vicinity of en route lodgings would not alter the situation unless the vehicle is laden. A driver may not operate a laden CMV as a personal conveyance. The driver who uses a motor carrier’s Commercial Motor Vehicle (CMV) for transportation home, and is subsequently called by the employing carrier and is then dispatched from home, would be on-duty from the time the driver leaves home.

    A driver placed out of service for exceeding the requirements of the hours of service regulations may not drive a Commercial Motor Vehicle (CMV) to any location to obtain rest.

    doesn't say a word about miles.......so, delivering your last load and driving home is perfectly fine

    Absolutely. Only thing that might be an issue is if your home happens to be on the way towards your next load. Could get hairy there. As an OO this doesn't matter for me but a company guy could get himself in trouble if he/she doesn't fully understand how the provision works.

    The only thing I have a question about is when my home is where I pick up my next load. That said, I think if you showed the DOT that you had been off for 34++ hours after running PC, they'd say it's ok.

    Problem is so much is left for interpretation nearly anything is possible. I've found the less they know about my operation...the better!

    I’m not sure who wrote that negative review. But it is completely false. It’s more than likely a job hopper or disgruntled driver which every company has. Careless complaints like this a re very unprofessional and I wouldn’t want you working for my company. The fleet is made up of majority leased trucks from Ryder which the company has to pay a mileage fee for each mile to run. To dead head a truck home for 120 miles is completely false and inaccurate unless there is an emergency for the driver. The company would lose money. Also the pc thing is incorrect because if you get any level inspection they check the last seven days on the tablet. At which they would catch you pc everywhere. I have had two inspections this year that I have passed with no violations. There are a lot of family members and friends that know each other that work here. Example one guy drivers for them then recruits his father and then recruits his friend. There are a lot of long term drivers here also.

    Not sure about this hairy mess , but sounds like the driver wasn't too excited about it , weather it be false information or not.
    ...No need to defend this operation if it's legit , the truth will be exposed soon enough!!!

    Driver OOS rating isn’t that much better-4.5% vs. the 5.5% national average!!
    I’d say the OP’s grievances are plausible.
