For what it's worth there was a guy who was supposed to be tested at the same time as I was. He probably knew two days in advance like I did, but I talked to him a day after the test and he said he didn't even get tested. Supposedly our dispatcher forgot to tell him, and he didn't show up for the test, even though he was at work. As far as I know he is still working. I figured that should be a refusal per the rules. I suspect he knew he was supposed to be tested, but who knows maybe it really was just a mistake. Obviously I don't think he would tell me if he was going to fail, but I told him I was getting fired soon lol.

That's a great example. They test who they want. Period. Even supervisors much lower on the management ladder will have ways to do what they want when it comes to testing.

You didn't pay attention to your drug and alcohol training [if the carriers did it] and it is obvious that OP's carrier isn't following the regulations.
The carrier can sit on the randoms and can pick and choose when they notify the candidate BUT once notified the candidate has limited time to get it done before it becomes a refusal to test in the eyes of the DOT.
There are a lot of carriers who bend and fold the notification rules as shown by the contents of this post.
Usually no skin off the driver's back BUT the carrier will pay a lot if audited.
While most of the fines levied after an audit end up negotiated to a lesser amount; Drug and Alcohol regulations are not negotiable. -
This is like clapping with one hand with you. You're arguing a moot point with yourself. The time to proceed to the nearest clinic after notification has nothing to do with what we're talking about if he isn't officially notified. The rules are broken (bent) as often as speeding is.

My son does HVAC,he is on the commercial side and does the startups on new installs, so he goes in behind the installers and tests everything before actually firing up the unit. Love's his job is super happy he gave up on the driving thing and went back to HVAC school.
