Wow a towing companying wanting between $96 000 - $126 000 think we're all in the wrong industry by the looks! How'd they get to that figure? Thats a lot of man hours to be charging you. If I was the insurance I would not want to pay that sum either. I do hope you can get all this mess sorted out though, all the best mate.

He said in post #9 that his CDL had been downgraded because his state DMV had not received documentation of his last physical. So when he wrecked the truck, he was driving without a valid drivers license (CDL). I can see an insurance company trying to use this as an excuse not to pay up. I would still get a lawyer involved. And also, that towing company is still liable to take sue him to try and collect their bill.

I saw that but I know they would have still honored their policy.

I wish I knew. Maybe they saw an opportunity to steal a golden egg without any effort.

He also said that he did not receive a ticket for that. So, my thought was, if his insurance didn't know for the last 10 months how would they know now? Especially if he immediately went and fixed it.

    Siinman Thanks this.

They gave you no reason(s) for denial of claim?

    You didn't ask?

It should be in writing, and very easy to read.

Your lawyer should be "talking" to that testing center that didn't submit correctly your completed medical in a timely manner causing your license to be downgraded. Your DMV record should be appealed after the testing center re-submits and any tickets issued should be appealed as well.
After this the insurance should be appealed after this is done. Your lawyer should do it all.

Maybe things have changed in the past year or so, but I have always had to submit my forms to the DMV in my state myself.
The doctors office, clinic, or testing center does not do that for you.

Sometimes it seems they do that, with the stuff they have you fill out. But they don't. That is up to the individual to send it in - and to verify that it has been accepted and completed.

Even if the testing place said they sent it in, the driver should check with their DMV to make sure.
After all, it is their license status that is at stake here. And it is simple enough to check.

... I dont get it ... Multiple questions on insurance reasoning not to pay and the guy just quet ... You didnt have CDL, unit wasn't insured , driver not on the policy - you are starting the topic and hiding part of the story ?
I had my car hauler stinger burnt to the ground with cars in 2013 and that unit wasn't on the policy , but that was my agent mistake, took me near 1 year to sue him and get it straight through his error and omission policy
