Benefits for domestic partner

So if your gay you can't be in a domestic partnership, but if your straight you can? Sounds like a court case to me. SCOTUS by some experts opinion is going to make gay marriage legal in all 50 states soon so if thats the case then I'm thinking domestic partnerships will be extended to both. So its probably not going to an issue for much longer. Then discrimination cases will start to fly if you allow one but not the other.
