If an "worker" is on commison or percentage you can 1099, you can not 1099 an hourly worker. Being said, you would not be an employee but rather an independent contractor. This comes from my CPA. You are the type of person I would dred to come in contact with, just someone with thier hand out looking for something for nothing.

check with another cpa because mine told me that you can not tell an independant contractor when or how to do his job. If you are dispatching that truck it disqualifies you from 1099ing them.

I have sent my CPA an email for confirmation. Someone said I was being greedy, lets be real. If I had to pay the taxes for payroll and workers comp, I would not be in business. I would have 0 profit and actually come out my pocket to cover this. I would have no way of repaying myself for the investments in the equipment. And saying that company owners screw thier workers is just ignorant.
You see the post, I am looking to offer benifits to my guys, but here I get attacked from some of you for trying to do something good for my guys. I do understand the point being made and will certianly look for a loop hole to the 1099 pay, wheather I need to rent the equipment to the driver and somehow bill it back etc. I will certianly get this taken care of. -
What I said was since you own your equipment the is no reason you should not be able to pay the witholding taxes.
If you can not afford to pay your drivers and pay your share of there taxes then something is wrong and you need seriously to look into what you are hauling with your trucks -

So you can't afford to pay your drivers the right way, and your profits are thin, but you are in the market for chrome and chicken lights. -
Lets not take this out of context. I pay my drivers very well, better then most. Just because I own my equipment does not mean that I do not need to pay myself back as a loan to the business just like a bank with intrest.
For arguements sake lets run some generic numbers:
Truck Gross weekly say 3500.00
Fuel 1800-2000 week
Driver 1050.00
Left over would be around 450-650 week
Now lets add 31.286% for PEO (all taxes/workers comp/ etc)
312.86 week
Subtract 312.86 from the above 450-650
Now leaves us with 137.14 to 337.14 per week.
Now lets add in Insurance at about 50.00 wk
So now were looking at any where form 87.14 to 287.14
Now add a payment and money for any repairs guess that pretty much leaves me in the negitive, so please tell me where is the greed coming from you so nicly mentioned, what because I should be able to make a profit, this makes me greedy.
Apparently as a driver you have no clue about business ownership, and hence this is why your a driver.
I took a chance on getting back into this business, it was a calculated risk and yes there is room for profit but not if I have to pay the payroll taxes/workers comp etc and pay a good wage.
By paying my drivers on a 1099, I am able to pay them more, if I have to go to a PEO service the drivers wages would need to be cut back to atleast 200-300 per week. I am here to make money and I wish to see my drivers make money.
It seems that people who think of another person that owns a business assume that this person has lots of money. I burned up my life savings investing into these trucks, I will not walk away from this without a fight and recoupe all my investment period.
The only thing that scares me is people like the guy that brags about sueing his employer(s). I cant fricken stand sue happy people, you were hired and excepted the job, and then sue cause you feel you were shorted, my 2 cents, you should not have taken the job, you a complete discrase to the american race. Hope your kids dont grow up to be like you. -
I have to say two things, one I am sorry for even starting this post and two, its seems very clear to me why drivers are frowned upon by management. Some comments on this post have been at best plain ignorant and on top of that I am in a forum that asks for another O/O's answers and opinions, instead it seems like a bunch of winny #$$ drivers doing their normal complaing.
If you can honestly tell me that even 50% of O/O's are paying other then 1099, I would find this highly unlikly as they would be out of business or just own thier own truck and thats it.
You can ban me if you see fit, but as I already stated I did not start this thread to debait payroll, just to see what O/O's were doing to provide insurance benifits. -
You asked a question I told you what my cpa told me. I didnt say what everyone else is doing. I know what everyone is doing and I know we got sued for it so obviously we did it too. But we didn't do it after the fact that's for sure.
as for insurance look into blue cross blue shield. My uncle owns a logging co and they have a policy through them for there drivers that's not too bad. Not sure if they 1099 or not -
I was just reading thru the IRS's 20 point checklist and I will have to verify with my CPA on Monday. -
