Sorry.. O/O or I/C? what is that? If I have no right to the information then that makes me an EMPLOYEE correct? I get that. I have no verbal/written lease of their truck, they take no money from my pay for such. I am just going to fill out the SS8 and let the IRS figure out if I am employee or contractor.

Owner Operator or Independent Contractor aka Lease Operator. You are neither, you're an employee falsely classified as an independent contractor. That's what the IRS will determine for sure. What happens then I don't know but I'm sure the company will be in some trouble.outonalimb Thanks this.

O/O is an Owner/Operator. I/C is an Independent Contractor. L/O would be a Lease Operator.

Okay so just to make something perfectly clear.
I saw an add for CDL driver. I called the folks they sent me application via email. I filled it out and emailed it back to them. They in turn called and said, go to this place on this day and take this Pee Test. I did. Couple of days later called and said I was Hired. Need you to bring us Medical information. Took them medical information. Couple of days later called and said they had a load. I went they gave me their fuel card and the pick up location. I left for my first job.
I filled out a job application !!! No lease agreement for using their truck.. verbal or written. For months I had to FIGHT tooth and nail just to get a copy of my paystubs, ( computer crashed But we'll get em to you, we are out of ink ) If you could just see the stubs they gave me... you would shake your head too and then start to question EVERYTHING.
AS SOON as I started asking questions, I am left sitting on the road somewhere for 2/4 days after a 34. So in one week for example I had only 1 load. I get home for the weekend and on Monday I call them and ask.. what we got? (as our usual routine) they say "Nothing Still looking" after one week of this I finally ask them If I even still have a job? They say "yeah but things are just real slow" Another week goes by and Finally they call. How am I suppose to do this. I am so done. I am going to the IRS. Lawyer and anyone else that will listen. -
Thanks - but I am none of these. I pay for nothing but my food while on the road.
I don't pay for use of their truck. I do not pay for anything Truck related and If I do they reimburse me for it.. like tolls, tars, straps. One time their Fuel Card was rejected. I had to pay out of my pocket. They reimbursed me for it.
Time for some legal advise and SS 8 with IRS this is getting to much -
As owner of 23 trucks. I employed 25 drivers. I also had 6 owner operators that leased on with tractor only and one with tractor/trailer. I had direct accounts that broke down the rates between permits, fsc, linehaul, escorts, etc. I paid all company and O/O on percentage of line haul. The fsc was passed straight thru to contractors. If I had a broker load which was rare they usually came across at a flat rate. I broke off a fuel surcharge and took company driver pay from that, as such with the contractor I did the same and took my percentage from the line haul and passed on to them the remainder. That is above board. As a member of the IMTA I was chastised by the other members for doing that as I was giving away money. Now there are 1/2 dozen or so doing it. It's what is right and fair. Now as for you seeing either the rate confirmation or the billing documents. If you are paid by percentage then you do indeed have the right to request examination of those documents. They should be readily identifiable by load number or however you receive the information. I had a few guys want to see the information but it eventually waned. I did begin putting a direct copy of the freight bill for very load in with the company drivers pay statement. I have always done that with a contractor. I have never had a quarrel with anyone over not getting their correct pay. I also never make them wait for their pay until a freight bill is cured. If you are having issues with a company that holds your pay or balks at showing you freight bills if you are paid by percentage then leave them immediately. You do have avenues to pursue to remedy a cure (OOIDA has a legal team and will give legal advice as to laws but won't represent you) but it will cost you up front to gain legal representation. I will admit as a small company, I hate these fly by night outfits that screw over drivers and would like them all to go out of business. Just too bad they screw over a driver doing it. That is how small companies get a bad name.

Thanks for your input!! it is greatly appreciated. I drove OTR with a big company before where they paid mileage. all of this % rate thing .. YES I should have done my homework, but heres the thing.. I was hired on as an employee, so I didn't know I had homework..you know what I mean.. This company has and is still doing some shady stuff so I am out as soon as I get back in. I think its time for a different company. Thank again!!

The IRS will find the company mis-classified you as a contractor. The company will have to pay their share of employment taxes, for sure, plus whatever penalties.
Does anyone know who pays the employee share in cases like this?outonalimb Thanks this.
