    Having some issues regarding downtime compensation.

    Well seems I am not covered by downtime compensation with my insurance. I did not know it was an added cost. I am covered for the repairs and everything else.

    So I submitted a downtime compensation form to Koch. I put in all my numbers and adjusted everything for approx 20 days of downtime.

    Koch responded that I should be mitigating my own personal losses, by renting a truck to recover income that way. They offered $150 a day for 5 days, because thats all it should take to repair the truck. Said that was industry standard.

    How ever,.. with everything being dragged out and not being able to come to terms on either side, this is much more than 5 days, and considerably more than $150 a day in NET losses.

    I am trying to look up what exactly is 'Industry Standard' for an O/O's down time? Any suggestions or insight from you guys would be helpful. Should I hire an attorney at this point? Do I have a leg to stand on?

    As of right now, I have not received anything and my truck is still waiting to be repaired.

    Financially I am fine and can weather this. Just dont want Koch to think I will just lay down like a dog and take what ever they hand me.

    ID sue them.....There is no "industry standard" downtime...call there bluff and sue.....

    Hurst, I got the name and number for a down time lawyer in Fleming Island Fl.
    She helped me when I had to sue my former carrier over down time loss of my trl.
    She takes 33 1/3 percent. No cash up front

    Rent a truck?? You'd barely break even. I think a simple letter of intent to sue should give them a quick attitude adjustment. A letter of intent from a decent law firm shouldn't cost much.

    I saw their website when looking up 'Downtime Compensation'.

    I looked into renting a truck the next day after I was hit,.. the costs are absurd, under powered, no inverter or APU. My truck isnt much to look at,.. but after 2 years, I have it set up nice.

    I agree,.. its time to lawyer up. I'm sure if they have their own claims dept,.. they have lawyers on retainer. I dont care,.. my claim will grow daily until my truck is out of the shop. I'll gladly give up 1/3 before I except $750 after being down for almost a month.

    What a joke.

    That Koch claims department is just a den of master manipulators and have math formulas to calculate denied claims. Your going to get the immediate shaft. Think of the alarming percentage of sheeple that back down after that first abrupt phone call they make with Koch claims. They don't even complain and think they are only with $150 for 5 days and move on. So sad.

    Remember the fight club new car recall scheme scene? If the cost of the recall equals more than the lawsuit payouts, they don't issue a recall. Same philosophy here.
