Heading to drop my 14 year old to school and got stopped by a motorcycle cop at the curb for nonetheless speeding. I know the seriousness of the matter and there is no excuse but in all honesty it was a test day, we were conversing and i did not realize I was over the limit until I saw the officer practically on top on my hood waving me to the right. Officer said I was going at 52 on a 30 mile per hour school zone. There were no flashing light for school zone ON, he gave me the ticket for going at 44 instead of 52 according to him because he wanted to be nice to me so now the ticket is for 14 miles over the limit. This is my first violation and my question is, should I hire a lawyer or just go to court and represent myself... I really have no excuse but I am willing to fight it to the end. What are my options? The officer said I can take traffic school but I do not think that applies to CDL drivers. I live in Florida. Please advise.

You know you were speeding. He gave you a gift to save your CDL. Pay it and move on. No traffic school for CDL. If he wrote it for 52 your CDL would be going in the dumper.
Puppage, Hammer166 and TruckDrivingtn Thank this. -
No Traffic school for you!!!!! Pay it an roll how much time you going to waste to fight a ticket especially if you know you were speeding and it your first one in a while. -
Hire a lawyer and fight it on the fact the officer committed purgery by falsifying a court document knowingly.
And then....

Fight the #### thing.
You guys are really gonna make a moral stand over a speeding ticket when rapists and drug dealers walk all the time?
They know they did it too, don't they?
Not saying it's okay but if you can exploit something to get ahead by all means go for it.
It's gonna save you on insurance, job security, etc...59EX, skinnytrucker, Ruthless and 1 other person Thank this. -
Comparing heinous crimes to speeding is like comparing Rosie O'Donnell to Jennifer Aniston.
Go ahead, fight it. Dollar for dollar, let me know how that worked out for you. -
You admitted you were speeding.......man up and pay for your faux pas and move on........you KNOW there have been many times you should have been busted and didn't get pulled over so this was Karma catching up

Wait about 10 days, so it can get into the system, then call the DA's office & ask if they can help you out by reducing it to a non-moving violation. 99% chance they will, if in fact you haven't had a ticket & asked for help from the DA within the last year. I KNOW for a FACT this works 99% of the time. Over my 30 years behind the wheel of a big truck, I have done this on a few occasions & it has worked every time. They will try to help you, by reducing it to a non-movable violation. It doesn't go on your DL & no need to report it to your company. Additionally, you don't need to spend the money on an attorney. In reality, that's the first thing he is going to try. If it works then your in good shape. If it doesn't work for you, then get an attorney & contest it. Its worth it.
Normally, you will pay the same fine for that speeding ticket but it will be a non moving violation.
Some jurisdictions will allow you to pay the lower fine of the non moving violation they reduce it to.
Sometimes they will tell you that if you get another violation within 6 months in their jurisdiction, the ticket will be reinstated & will go on your licence, etc. -

Keep in mind that its going to take them a few days to run you through the system after you talk to them & give them the info. They need to check that you haven't asked within the last year or certainly that you don't get into this every few months etc..... Check that you aren't wanted or have other issues.
So, when you call them, its going to take about a week before they send you a letter that says what they are willing to do for you.
I am confident that they will help you & you will come out ok on this. As well, you will not talk to the DA but will talk to an assistant & they will give it to an assistant DA to look at this. It all just takes a few days to get worked out.
Once you get the letter, take it to the jurisdiction office where you pay the fine & they will look it up. Just pay the fine etc & be on your way.
I hope this helps.
