Broker/Shipper left me stranded for over 24hrs on busy highway.

    The picture of the scene in the news article looks like it is maybe 1/2 mile or less to the next exit ramp, a much safer place.
    I don't care what is wrong with the trailer chassis, I can yank it that far. After about 60 minutes of run around from dispatch or the broker that is what I would have done.
    Now, all of the parties involved, the broker, the company he is leased to or works for, him are all going to be named in the wrongful death suit.
    And they will win.

    Trust your instinct, not a dispatcher or broker to solve your problems...
    If you don't know how to help yourself, nobody will. You need to rely on yourself first...

    Typically the brokers don’t cover anything after the container/anything leaves the ports or rail yard. I remember reading when I signed up to use BNSF that me/my carrier is responsible for repairs once it’s out. Most ports/rails have terminal lanes where any repairs will be made that the drivers bring to attention.

    this sounds like a high chance of the chassis loosening up. These are pre chained i believe.

    I agree in essence but sitting on a shoulder for 24 hours is not an option. Highway Patrol needs to call a wrecker to tow it. That's regardless of whether I am a company driver or a o/o.
    I just can't get it how can someone allow himself to sit on a side of the road for that long.

    On the other hand, having seen the report, I don't know if he should be at fault 100%. The garbage truck f..ed up there by going off the road and they should be blamed mostly for this. They might as well have rammed into an ongoing random DOT inspection on a shoulder (OH or IA style) or 5 minutes after he broke down and just about ready to put up those triangles...

    I guess, at first, he angered me by stupid questions if he can sue them because they "had him" sit there for so long...and he had to obey the orders, so I wasn't sympathetic but now, I am changing my stance here. Because that accident was not exactly due to his presence there.

    It looks this guy is one and done. There's no reason for more responses, unless he follows up with some more info.
    And that is questionable.
    I can't believe he was there for that long and the police didn't notice him at all.

    Actually there isn’t a maybe, the garbage truck would not have hit anything if the truck was not there so yes it is EXACTLY the reason for the accident.

    two questions that seems to be raised here is;

    1 - was the driver liable for the accident?

    i say yes.

    2 - did the garbage truck use the shoulder as a means to avoid an accident that was caused by another vehicle?

    maybe, we don’t know, the garbage truck drive is the only one who can say.

    a follow up question, if the truck was there for 24 and no triangle or flares were used, where were the cops? Did they stop to see what was going on?
