True and it's another reason why the Carrier must be looking out for their best interest the best they can instead of doing what's "right".
Almost everything is setup to be in their favor and against us.

All the protections the Feds have made for the carrier in the Carmack Agreement are forfeited in those Broker/Carrier Agreements. I do my best to bring my A game but I'm not going to shoot myself in the foot either.

It's not just the days/time involved. It's also going into a dead area so the mileage rate needs to be roughly round trip. I also wasn't in Reynoldsville so the miles to get there have to be factored in. All miles would have been close to 1350. Even at 2/mile that's 2700 dollars but I don't haul for that rate.

Fuel is too expensive now and every single one of my operating expenses have increased by 25-35 percent. Then all my personal living expenses have gone up as well. They need to be paid for. Driver needs to have a decent wage or this business isn't worth operating if I can do better as an employee for a company somewhere else.

There's tolls too. They need to be rolled into the rate as well. PA has the highest IFTA in the entire country so it's another expense that needs to be considered.

All this adds up so 2/mile is no good. Maybe two years ago but not now and I doubt I'll ever see it that low again in my lifetime. If you don't pay attention to all these things and add them into your rates then you're bleeding revenue and essentially dying a slow death via a thousand paper cuts.

You don't wanna B.S.? Go fishing then. Trucking is an unregulated business, B.S. comes with it. And you have to accept it.

Don't like the shipper? Don't accept the load or cancel as soon as you find who he is. Don't go there, see too many trucks ahead of you and decide to cancel, putting the broker in a tough spot.

$100/hour detention is unrealistic, money don't fall from the sky.

Recaps. So long as you don't reach your 70hrs in a period of 8 days, you could theoretically keep running every day without having to take a 34 HR restart.

Have you never used recaps before?

Thanks for mentioning the Carmack Agreement, I learn something new everyday.

Did some light reading on it and it appears the Carmack Amendment primarily deals with liability for damaged goods. A lot seems to be establishing jurisdiction, state vs federal, in claims. It outlines a few different methods for a transportation company's defense in a damaged goods claim.

Deeper in the weeds of the case law it shows how a carrier can impose their terms of service, or tariff, by having it posted on their website which could include things like detention and fuel surcharge.

My question to you is what specific protections from the Carmack Amendment are most commonly forfeited in Broker/Carrier Agreements, so that I can judge brokers accordingly?

Regs here require days off, i cannot just make my staff drive 365 days a year, even if they only drove an hour a day.

    Its against the law.
They get a minimum of a day off per week, and also must receive paid vacation time annually.

Sorry i neglected to answer your question as well.

Yes my employees can of course quit any time they like. The last one to actually quit was in 2016, and he was back a month later begging for his job back.

    Siinman and LameMule Thank this.
