Business type change

    Inquiring for a friend here, who happens to be too lazy to join such an awesome site.. Anywho he's looking to change business structures. I believe he said from a DBA to an LLC. I told him to stop by at the irs office which he claims he did, they said they couldn't do anything for him there and gave him a number to call. Claimed he was on hold for over an hour and hung up.

    Does anyone have any experience with this? I'm assuming there is a former to fill out. I tried looking for one myself to fax to him but no luck...

    Most states have some form that you fill out to register the business name that and a small fee later they send a certificate with the name of the llc. Also it would be wise to get a federal tax id# which is free.

    I used legalzoom.com. I think it was $300 for CA (3 years ago) but I had a coupon for $15 off. Just remember to cancel their registered agent service before the year anniversary or else they'll try to charge you $140 annually to be your "registered agent". Hope that helps

    You need to go to your state website and see if your name is available. If it is available, then you can file your LLC. Many states will allow you to incorporate or file a LLC or corporation on line. There will be a filing fee. You should be able to do it yourself. Today, it is mostly fill in the blanks. Once you have your LLC, you can apply for a FEIN with the IRS. It is really a simple process.

    I helped by dad incorporate from a dba a few years back. It was straight forward and I did everything in about an hour in the irs office. I did have to call that number they give you and remember being on hold for more than 1/2 hour but other than that, it's easy. There was a few that i had to pay upfront and other fees that came in the mail at a later date.

    When I set up LLC's, I just go to the local department of state office. I fill out the form, pay for the sealed certificate, and Im on my way.
