Buying my first truck, should I form an LLC?

    nope not with an LLC, there isn't a way to set it up to protect yourself if you are an owner and operator or a negligent owner.

    Sorry ... but this has been proven in court a bunch of times.

    The one thing you all miss is there has been hundreds of fraud and negligence cases that have held the owners of a business accountable for their actions or lack of. In this industry, liabilities are higher than the norm, we deal with accidents and fatalities and a public interface that no other industry has. With the present judicial system this makes all of us an easy target for those seeking damages to cash in an on accident, even if it is their own fault.

    An ambulance chasing lawyer, who advertises on billboards to chase big bucks against trucks have provided the means to breech the wall of protection for a while and especially with LLCs.

    1. Why has the media not given us the name of the owner of Castellano 03 Trucking LLC?

    2. What does the state of TX mean when it says they do not maintain ownership records of LLCs?

    3. What does “limited liability” mean?

    Ridgeline, as many trucks as you have, you must have a lot to lose. How do you go about protecting yourself from losing everything?

    I will ask my lawyer to get a list, I looked for the list of a bunch different case but I can't find it.
    I have a c corp and companies under it. I take limiting my liabilities seriously, from documenting everything that has to do with drivers and trucks to having policies to deal with problems and questions. I've been sued before and these things saved my butt.

    Thanks. In regards to the companies. So, your C Corp is like a parent company then have additional companies underneath it?

    I know everyone hates ELD’s but frankly in a way I’m happy we run them now. It’s tsken such a huge area of risk and minimized it. It was much much tougher to police your drivers so to speak before because they could cheat their book they turned in just like they would for police but if got into an accident investigators would have figured it out. How do you feel about eld in that sense?
