They can but then you can decide to sue them for it, because there is no real employment involved. You have to actually work there, be compensated for the work and then they can claim you as an employee - not until then.

I would exit gracefully, be honest with them and return everything they gave you. If they get nasty, just smile and tell them you are sorry but you have a better opertunity, and if they threaten you, just tell them you never worked there so there is nothing they can do about it - period.

Do they still have any positions? We live in Cottondale area and my husband is looking to change. As far as the dac he went to work for USA never made it through all of the orientation put him in a team driver scenerio and when it came time for the friving test he failed. I will mention he already had his cdl tanker etc. The trainer said he should never have been put in that position but he was. Well they DID put it on his dac report. But all it said was no rehire.

I live near Fort Worth, TX so I am unsure where Cottondale is but you can look at Craigslist, I've seen a few Fedex driving jobs on there, at least around here, he would need double/triples. Like any other job, if someone calls to check your previously employer they will ask if that person is rehire-able.

So what would happen if lets say I decided to do the OTR job and i'm like 4 weeks in and decide this team thing is not for me and give my two weeks notice, could this affect me getting another truck driving job for leaving so early?

Why not apply for a solo job? And another company will understand teaming was the problem for you if you have to move to another. Call today and get into an orientation to not have a gap in your employment.

As a student you need to hop before you reach 90 days post-graduation date because on day 91 you'll have another problem, becoming employed as a student driver.

Seriously now, move quickly into another DRIVER job.

Also you can get on at a company that does both. Start as a team and if it doesn't work out go solo. That way you can taste teaming without hopping jobs if you don't like it.

You are not an employee until you actually start earning wages. Many drivers go through orientation and get orientation pay is why that is the beginning of their employment.

I highly doubt they would put anything on your DAC. That's if they even subscribe to it. Only a small fraction of companies use it and that's mainly the larger ones. Being a FedEx contractor he probably is a penny pincher. He doesn't have an orientation tells me he goes about things informally.

Even at that you can dispute it and the company would have to prove that you worked for them or it would be removed.

Even more at that :) nobody else is going to reject your future employment because you applied for more than one job. The best man wins rule comes into play.

You are worrying over nothing. Congrats on the new job which ever one it is.

I just graduated school back on Aug. 23rd but I thank you for the advice. I already ran into a couple that say they only hire within 30 days, I do have a couple other offers to attend orientation but I cannot start any of them till after Oct. 15th as I will be out of the country.
