They can't force you to wear anything. But they can refuse to load you/unload you/allow you on the premises.
I hate wearing even a reflective vest, but the way to minimize your interaction with such people is to simply comply when asked to.

Reminds me of the good old mask days. Do you know shippers hate the guy who is anti mask and stirring everyone in the waiting area into a rebellion?
I always got unloaded quick at those places. I don’t wear masks and if you want me to?…be prepared! I just wish more drivers stood with me. Was amazing how many put on those face diapers and didn’t question anything. They still don’t! -
The short answer is yes, the long answer is yes. I have a friend that's director of safety for a small flatbed company, they had a driver, first trip out loading lumber at a mill. Mandatory steel toed boots or overshoes, reflective vest, hard hat, long pants. He refused to wear a hard hat, it messed with his man bun, they refused to load him and banned him from the property. When he called in to dispatch that he was being refused and they asked why, he told them, he was recalled to the yard and fired. I deliver to mines on occasion, MSHA rules are not to be messed with.

I just don't get why people feel like it's some violation of their constitutional rights to be asked to conform with house rules. If the sign says "NO SMOKING", you're not allowed to smoke. This is not an infringement of the rights of smokers, it's a protection of the rights of the property owner.

I guess the other side of it, you're asked to follow PPE rules, you fail and are injured, they can deny your injury/damage claim as you failed to follow property rules that are in place to protect you and them.

It's sometimes silly , but their playground , their rules as was said earlier . My job requires us to have everything too ( earplugs and vest , along with the fire resistant long sleeves and glasses and steel toes ) . Some guys wear it all day , some put it on , load , then take it all off .
I wear the shirt all day , along with the steel toes , but thats my deal . You just carry the stuff , use it when needed, pack it away for later.Lennythedriver, kemosabi49 and snowlauncher Thank this. -
People have been awarded money for being hurt while trespassing and burglarizing residences. Whether or not they wear PPE has zero weight on whether the company is liable for an injury. I mean, what happens if the driver gets hurt wearing full PPE? Then what?Last edited: Oct 10, 2024 at 1:51 PM
